NATURAL RESOURCE EXTRACTION FEE
AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, REGULATING AND ESTABLISHING THE
PERMITS AND FEES REQUIRED FOR THE EXTRACTION OF
NATURAL RESOURCES AND SUPPLEMENTING ORDINANCE NO.
25 AND NO. 365
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Purpose.
This Ordinance is adopted to regulate and establish the
permits and fees required for the drilling, mining, quarrying or
commercial extraction of natural resources within the City of San
Juan Capistrano. The term "natural resources" shall include oil,
gas, sand, gravel, rock, aggregate, clay, and other similar
materials that are extracted for financial gain; it does, however,
not include water.
SECTION 2. Permits and Fees.
All uses pertaining to the extraction of natural resources
shall require approval of Conditional Use Permit in addition to
the following specific permits and fees.
(a) Fees pertaining to the extraction of liquid or gas
resources:
(1) Well Drilling or Re -drilling Permit: required
at time of initial construction.
(2) Well Renewal Permit: required annually in
order to continue drilling.
(3) Business, License Tax: levied annually.
(9) Production Tax: requires a written statement
setting forth the number of wells in operation
and the amount produced by each well during
the previous quarter of production.
(b) Fees pertaining to the extraction of solid natural
resources:
(1) Mineral Extraction Permit: required at the
time of initial construction.
(2) Business License Tax: levied annually.
(3) Mining Tax: required a written statement
setting forth the total amount of material
extracted, regardless of whether or not all
the material is useable, during the previous
quarter of extraction.
SECTION 3. Fee Schedule.
The City Council shall, by Resolution, set the fees as
appropriate for the Permits and Taxes set in Section 2 above.
These fees may be changed, amended or deleted at any time by City
Council.

SECTION 9. Effective Date.
This Ordinance shall become effective thirty (30) days
from and after its passage and adoption.
SECTION 5. City Clerk's Certification.
The City Clerk shall certify to the adoption of this
Ordinance and cause the same to be posted in the duly designated
posting places within the City of San Juan Capis4rano within 15
days after its passage.

October 1 1979 , by the following vote, to wit:

Buchheim and Mayor Friess
