Ordinance Number 625 183 ORDINANCE NO. 625 ESTABLISHING RESTRICTIONS ON DEVELOPMENT PROPOSALS FOR EQUESTRIAN USES AN INTERIM ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING RESTRICTIONS ON DEVELOPMENT PROPOSALS FOR EQUESTRIAN USES, OR ADDITIONS THERETO, PURSUANT TO GOVERNMENT CODE SECTION 65858 PENDING ZONING STUDY THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Intent. The City Council finds that existing Municipal Code provisions regarding development standards for the establishment and additions to commercial equestrian uses, including but not limited to, commercial horse stables, are inadequate in that area of the City known as Avenida dela Vista. Accordingly, it is appropriate that the City Council prohibit the establishment of any new commercial equestrian uses, or any additions thereto, pending the study and eventual adoption of new development standards for commercial equestrian uses, including commercial horse stables. SECTION 2. Establishment of New Commercial Equestrian Uses or Additions Thereto Prohibited. Commencing on the effective date of this ordinance, no new commercial equestrian uses, or additions thereto, including commercial horse stables, shall be constructed in the Avenida de la Vista area (Exhibit A, attached hereto and incorporated herein by reference) during the pendency of the zoning study to be undertaken pursuant to this interim ordinance and Government Code Section 65858. This prohibition applies to any development proposals, including any land use application for such a use presently on file with the Department of Community Planning and Development. SECTION 3. Zoning Study. The Department of Community Planning and Development is directed to initiate a zoning study for the purpose of adopting new development standards for the establishment of commercial equestrian uses, including commercial stable operations. The zoning study shall include a review of appropriate requirements for the density of horses per acre, open space needs, and criteria for evaluating the effects of stables on adjacent properties. SECTION 4. Findings. The City Council finds that this interim ordinance is enacted pursuant to Government Code Section 65858 to protect the public health, safety and welfare in that the processing of applications for new commercial equestrian uses, or additions thereto, will cause such potential problems as increased odor, noise, dust, parking, light glare, and traffic congestion on adjacent properties. SECTION 5. Term. This interim ordinance shall be in effect for a period of 45 days from the date of its adoption, or until June 3, 1988. -1- 184 SECTION 6. Effective Date. This Ordinance shall take effect immediately. SECTION 7. City Clerk's Certification. . The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published once as required by law and posted at the duly designated posting places within the City of San Juan Capistrano within fifteen (15) days after its passage.
