ROLL CALL BOARD MEMBERS PRESENT; Wyatt Hart, David M. Swerdlin, John S. Gelff, Vice Chairman Joe Soto and Chairman Diane Bathgate BOARD MEMBERS ABSENT: None STAFF PRESENT: George Scarborough, General Manager; John Shaw, Legal Counsel; Meg Monahan, Clerk of the Board; Cynthia L. Russell, Administrative Services Director; Thomas Tomlinson, Planning Director; William M. Huber, Engineering and Building Director; Amy Amirani, Public Works Director; Al King, Jr., Community Services Director; Lt. J.B. Davis, Chief of Police Services; and, Dawn Schanderl, Deputy City Clerk. CONSENT CALENDAR Board Action: Moved by Director Hart, seconded by Director Gelff and carried unanimously, 5-0, to approve items 1 and 2 as recommended by Staff. MINUTES FROM THE REGULAR MEETING OF JANUARY 7, 2003, APPROVED AS SUBMITTED. 2. RESOLUTION NO. CVWD 03-02-04-01 ADOPTED ENTITLED "A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CAPISTRANO VALLEY WATER DISTRICT ACCEPTING PUBLIC WATER FACILITIES RELEASING RELATED SURETY BOND, AND AUTHORIZING ISSUANCE OF A NOTICE OF COMPLETION FOR PUBLIC WATER FACILITIES (J & P DEVELOPMENT) (PARCEL MAP 89-393);" AND, CLERK OF THE BOARD DIRECTED TO PROCESS RECORDATION OF THE NOTICE OF COMPLETION FOR THE PUBLIC WATER IMPROVEMENTS WITHIN THE SUBJECT PROPERTY. (600.70) CVWD Minutes 1 02-04-03 BOARD ACTIONS: C1. DISSOLUTION OF THE CAPISTRANO VALLEY WATER DISTRICT FORMALLY ACKNOWLEDGED; AND, STAFF DIRECTED TO TRANSFER TITLE ON ALL ASSETS FROM THE NAME OF THE CAPISTRANO VALLEY WATER DISTRICT TO THE CITY OF SAN JUAN CAPISTRANO (1050.10) Project Description: In 1997, the Capistrano Valley Water District (CVWD) consolidated operations with the City with the goal of completely dissolving the CVWD upon resolution of a number of issues. The CVWD and City have completed all negotiations and agreements necessary to move forward with the merger and dissolve the CVWD. Staff recommends acknowledging and accepting the dissolution of the Capistrano Valley Water District and direct staff to transfer title on all assets from the name of the Capistrano Valley Water District to the City of San Juan Capistrano. Russell, Administrative Services Director, reviewed the staff recommendation. Board Action: Moved by Director Swerdlin, seconded by Director Hart and carried unanimously, 5-0, to formally acknowledge, by receiving and filing, the dissolution of the Capistrano Valley Water District; and, staff directed to transfer title of all assets from the name of the Capistrano Valley Water District to the City of San Juan Capistrano.
