REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA
CLOSED SESSION (610.85)
Council met in a Closed Session at 5:30 p.m. for the following purposes as authorized by
statute:
1. Pursuant to Government Code Section 54957.6, the City Council met with its labor
negotiator (City Manager) concerning terms and conditions of employment with respect
to the Management/Classified employees.
RECESS UNTIL 7:00 P.M. BUSINESS SESSION
The Regular Meeting of the City Council of the City of San Juan Capistrano, California, was
called to order by Mayor Hart at 7:03 p.m., in the City Council Chamber, followed by the Pledge
of Allegiance to the Flag led by Council Member Greiner. Invocation was given by Mayor pro
tem Swerdlin. The Meeting was dedicated to the late Maryrose Winkler.

Mayor pro tem Swerdlin introduced the following persons in attendance: Sheldon
Cohen, Planning Commission; Ilse Byrnes, Parks, Recreation, and Equestrian
Commission; Janet Siegel, Cultural Heritage Commission; Marie Buckner, Housing
Advisory Committee; Gil Jones, Former Mayor.

It was moved by Council Member Bathgate and seconded by Mayor pro tem Swerdlin, that the
staff recommendations be accepted for the following items listed on the Consent Calendar:
Items 1, 3, 4 and 6. The motion carried by the following vote:

2. APPROVAL OF MINUTES - REGULAR MEETING OFApril 17 2001
It was moved by Council Member Bathgate and seconded by Mayor pro tem Swerdlin, to
approve the Minutes of the Regular Meeting of April 17, 2001, as submitted.
The motion carried by the following vote:

3. RECEIVE AND FILE WARRANTS OF APRIL 19 2001 300.30

4. APPROVAL OF FEE REDUCTION FOR RENTAL OF DESCANO VETERANS PARK
HEAD START WEDNESDAY MAY 16 2001 3'.' 21
As set forth in the Report dated May 15, 2001 from the Community Services Director,
reduction of Descanso Veterans Park rental fees for a community event hosted by Head
Start on Wednesday, May 16, 2001 was approved as submitted.
5. APPROVAL OF AGREEMENT AMENDMENT FOR ADDITIONAL DESIGN SERVICES
FOR PARSONS TRANSPORTATION FOR I-510RTEGA HIGHWAY INTERCHANGE
PROJECT STUDY REPORT (CIP NO. 141) (600.30
Oral Communication
Gil Jones, 31791 Los Rios, requested that study take into consideration businesses
impacted by the project construction and plan implementation.
Mark Nielson, 51621 Via Quixote, suggested that Council consider staffing a position for
traffic design in lieu of outside consulting services.
Approval of Agreement Amendment:
It was moved by Mayor pro tem Swerdlin, seconded by Council Member Bathgate and
unanimously carried to approve the Amendment to the Agreement with Parsons
Transportation for Additional Design Services in the amount of $73,546 (CIP No. 141).
6. ADOPTION OF RESOLUTION IN SUPPORT OF THE ORANGE COUNTY
CENTRAL PARK AND NATURE PRESERVE 920.50
As set forth in the Report dated May 15, 2001 from the Community Liaison, the following
resolution supporting the Orange County Central Park and Nature Preserve Initiative that
has been prepared by the City of Irvine to accurately reflect the needs and desires of the
people of Orange was approved:

AND NATURE PRESERVE -- A RESOLUTION OF THE CITY OF SAN JUAN

APPROVAL OF AGREEMENT FOR CONSULTING ASSISTANCE TO CONDUCT A
CITY SERVICES AND RESIDENT'S ATTITUDES OPINION SURVEY (FAIRBANK,
MAKIN, MAULIN & ASSOCIATES) (600.30
Written Communications:
Report dated May 15, 2001 from George Scarborough, City Manager, recommending
approval of Consulting Assistance Agreement to conduct a City Services and Resident's
Attitudes Opinion Survey.
George Scarborough, City Manager, made an oral presentation.
Approval of Agreement for Consulting Assistance:
It was moved by Council Member Greiner, seconded by Council Member Gelff and
unanimously carried to authorize the City Manger to negotiate an agreement for
consulting services with Fairbank, Maslin, Maullin & Associates, in an amount not to
exceed $25,000 for study of Voter Opinion Research, and authorize the City Manager to
execute the agreement on behalf of the City of San Juan Capistrano.
2. APPROVAL OF LONG-TERM USE OF JOEL CONGDON HOUSE 260.501260.10
Written Communication
Report dated May 15, 2001, from George Scarborough, City Manager, recommending
relocation of a portion of the Community Services staffing to the of Joel Congdon House
and directing staff to develop a strategy for soliciting proposals from qualified nonprofit
organizations to create a museum at the site.
Oral Communications
George Scarborough, City Manger, gave an oral presentation outlining the staff report.
Mike Evans, 26465 Park Circle and George Kibby of Anaheim expressed support of the
use of the long-term use of the Joel Congdon House as a museum.
Jan Siegel, 27201 Calle Delgado and representing Questers, a nonprofit organization,
supported use of facility as an agricultural museum rather than office use.

Ilse Byrnes supported temporary staff use of facility and long-term use as agricultural
museum.
Approval of Long Term Use of Joel Congdon House:
It was moved by Mayor pro tem Swerdlin, seconded by Council Member Greiner and
unanimously carried to approve a revised recommendation to relocate a portion of
Community Services staffing complement to the Joel Congdon House, on an interim
basis for staff use, and to develop strategy for soliciting proposals from qualified non
profit organizations to create museum at the site.

Siegel, and Don Tryon
Housing Advisory (6):

The following recommendations were approved a) reduce Planning Commission
membership to 5 from 7; b) restructure Design Review Committee (DRC) membership to
include 2 members selected by the Planning Commission and 1 community -at -large
member with design background appointed by City Council; c) conditional appointment
of Jeff Parkhurst as at -large member to DRC; and appointment of Sheldon Cohen, Mike
Eggers, Tim Neely, George Proctor and Billy Sonka to the Planning Commission:

Angela Duzich-Rohde, Derek Reeve, Mike Rosenberger, Richard St. Onge, and Gary
Vogt
Water Advisory Board (5):

League of California Cities (140.20) — report on attending a Media Relations Workshop.
Orange County Joint Fire Authority (540.80) -- advised of new operations and training
center in progress.
3. REVIEW OF CITY COUNCIL APPOINTMENTS 610.60
It was moved by Mayor Hart, seconded by Council Member Gelff and unanimously
carried to add the Review of City Council Appointments to the Agenda.

3. APPROVAL OF GUNSHOT PERMIT BLANKS TO BE FIRED DURING THREE-
MINUTE WESTERN SHOW 585.10
It was moved by Mayor Hart, seconded by Mayor pro tem Swerdlin and unanimously
carried to add the item to the Agenda.
It was moved by Council Member Greiner, seconded by Mayor pro tem Swerdlin and
unanimously carried to approve Gunshot Permit that will allow blanks to be fired during a
three minute Western Show, May 16, 2001 at the Oaks Blenheim Rancho Mission Viejo
Riding Park.
COUNCIL COMMENTS
Sidewalk on Camino Capistrano 820.60
Council Member Greiner commented favorably on the sidewalk work completed on the
eastside of Camino Capistrano.
