SAN JUAN CAPISTRANO CITY COUNCIL
SPECIAL MEETING
Mayor Allevato called the Special Meeting of the San Juan Capistrano City Council to
order at 5:03 p.m. in the City Council Chamber. Mayor pro tem Kramer led the
Pledge of Allegiance.

COUNCIL MEMBERS/DIRECTORS PRESENT: Laura Freese, Derek Reeve,
John Taylor, Mayor pro tem Larry Kramer and Mayor Allevato
COUNCIL MEMBERS/DIRECTORS ABSENT: Taylor
ORAL COMMUNICATIONS: None
DISCUSSION ITEMS:
C1. INTRODUCTION AND FIRST READING OF AN ORDINANCE ELECTING TO
COMPLY WITH AND PARTICIPATE IN THE ALTERNATIVE VOLUNTARY
REDEVELOPMENT PROGRAM (AB X1 27) (400.80)
Omar Sandoval, City Attorney, reported that the California Supreme Court issued a
stay on Assembly Bill X1 26 and 27 on August 11, 2011, prohibiting the Community
Redevelopment Agency from issuing new debt, and stops any new activity;
provided a staff report, and responded to questions. Cindy Russell, Chief Financial
Officer/Treasurer, and Tom Clark, Agency Counsel, responded to questions.
Maria Morris, City Clerk, read the title of the ordinance.
1St Council Motion: Moved by Mayor pro tem Kramer, seconded by
Council Member Freese, and carried 4-0-1 with Council Member Taylor absent
(recused due to proximity of numerous Redevelopment Agency properties to his
residence), to read the ordinance by title only.

2ntl Council Motion: Moved by Mayor pro tem Kramer, seconded by
Council Member Freese, and carried 3-1-1 with Council Member Taylor absent
(recused due to proximity of numerous Redevelopment Agency properties to his
residence), and Council Member Reeve opposed to approve the introduction and
first reading of an ordinance entitled "AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA ELECTING TO COMPLY
WITH AND PARTICIPATE IN THE ALTERNATIVE VOLUNTARY
REDEVELOPMENT PROGRAM CONTAINED IN PART 1.9 OF DIVISION 24 OF
THE CALIFORNIA HEALTH AND SAFETY CODE"; including adding the following
language to Section 10 of the Ordinance: This ordinance shall be effective thirty
(30) days from and after the date of the final passage and adoption hereof,rop vided
