CITY COUNCIL
Mayor Nielsen called the Adjourned Regular Joint Meeting of the San Juan Capistrano
City Council to order at 4:39 p.m. in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS PRESENT: Tom Hribar, Laura Freese
(Council Member Freese arrived at 5:03 p.m.), Mayor pro tem Dr. Londres Uso and
Mayor Nielsen
COUNCIL MEMBERS ABSENT: Sam Allevato
PLEDGE OF ALLEGIANCE: Council Member Hribar led the Pledge of Allegiance
ORAL COMMUNICATIONS: None
DISCUSSION ITEM
C1. WATER AND WASTEWATER RATE STUDY REPORT; RECEIVE AND FILE;
AND STAFF DIRECTED TO PROCEED WITH THE PROPOSITION 218
HEARING PROCESS (1040.50/1050.20)
Cindy Russell, Assistant City Manager, provided a staff report and responded to
questions. Ann T. Bui, Black & Veatch provided a slide presentation and
responded to questions. Utilities Commission Chairman Daniel Merkle
participated in the discussion.
City Council Comments:
• Concern with allocation for larger residential lots.
• Need to consider the reality of water shortage.
• Need to further study impacts to users that fall outside of the average
user.
Council Action: Moved by Mayor pro tem Uso, seconded by Council Member
Freese, and carried 4-0 with Council Member Allevato absent to receive and file
the Water and Wastewater Rate Study Report; and staff directed to proceed with
the Proposition 218 Hearing process, with the understanding that the City
Council has the flexibility to make adjustments to the allocations at the time of the
Proposition 218 Hearing.
