REGULAR MEETING
BUSINESS SESSION:
Mayor Reeve called the Adjourned Regular Meeting of October
City Council of the City of San Juan Capistrano to order at
City Council Chamber. Mayor Reeve led the Pledge of Allegiance.
ROLL CALL:

COUNCIL MEMBERS PRESENT: John M. Perry, Mayor pro tem Pam Patterson, Esq.
and Mayor Derek Reeve.
COUNCIL MEMBERS ABSENT: Kerry K. Ferguson and Sam Allevato.
Agenda items are presented in the originally agendized format for the benefit of the
minutes' reader, but were not necessarily heard in that order.
CLOSED SESSION ITEM ADDED TO THE AGENDA TO DISCUSS AN ITEM THAT
AROSE AFTER POSTING OF THE AGENDA:
Council Action: Moved by Mayor Reeve, seconded by Council Member Perry, and
carried 3-0 with Council Member Ferguson and Council Member Allevato absent to add
to the Agenda the following closed session item: Pursuant to Government Code Section
54956.9(d)(2), the City Council will confer with Legal Counsel to discuss significant
exposure to litigation, threat of litigation by EI Nido Mobile Estates.

Jeff Ballinger, City Attorney, provided an agenda report and responded to
questions.
• Public Comments: Robert Coldren, Callahan and Blaine, Attorney
representing the EI Nido Mobile Estates park owner.
Council Action: Moved by Mayor pro tem Patterson, seconded by
Council Member Perry, and carried 3-0 with Council Member Ferguson and
Council Member Allevato absent to adopt RESOLUTION 15-10-26-01 entitled "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, DENYING THE APPEAL FROM CALLAHAN AND
BLAINE, REGARDING "EL NIDO MOBILE HOME ESTATES RESIDENT RENT
PROTEST PETITION" AND UPHOLDING THE ACTIONS/DISCUSSIONS OF
THE HOUSING ADVISORY COMMITTEE."

HIGHWAY (ASSESSOR PARCEL NUMBER: 650-621-01) (EL NIDO MOBILE
ESTATES) (430.10)
• Public Correspondence: Correspondences and emails dated
October 23, 2015, and October 25, 2015, from Peter S, Bauman, Callahan
and Blaine; correspondence dated October 25, 2015, from Julie Paule,
Regional Representative, Western Manufactured Housing Communities;
and correspondence received on October 25, 2015, from Bruce E. Stanton,
Law Offices of Bruce E. Stanton.
