17-0112_CC_Minutes_Adjourned Regular Meeting_Closed SessionMINUTES January 12, 2017 SAN JUAN CAPISTRANO CITY COUNCIL ADJOURNED REGULAR MEETING Mayor Ferguson called the January 12, 2017, Adjourned Regular Meeting of the City Council to order at 4:05 p.m. in the City Council Chamber. Rnl I CAI I COUNCIL MEMBERS PRESENT: Mayor Kerry K. Ferguson, Mayor Pro Tem Sergio Farias, and Council Members Derek Reeve; Pam Patterson, Esq., and Brian Maryott. COUNCIL MEMBERS ABSENT: None. ORAL COMMUNICATIONS/CORRESPONDENCE/_PUBLIC COMMENT ON CLOSED SESSION ITEMS: None. CLOSED SESSION (610.85) A Closed Session was held for the following purposes, as authorized by statute: a. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council conferred with legal counsel pertaining to the administrative proceedings in the Matter of the Application of San Diego Gas and Electric Company for a Certificate of Public Convenience and Necessity for the South Orange County Reliability Enhancement Project (CPUC Application No. 12-05-020). b. Pursuant to Government Code Section 54956.8, the City Council met with its Real Property Negotiators (Ben Siegel City Manager; and Jeffrey Ballinger, City Attorney) concerning the price and terms of payment concerning certain real property located at La Novia and San Juan Creek Road (APN: 666-011-20 and 666-011-21). Negotiating party: San Juan Hills Golf Club, LP. c. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council conferred with legal counsel pertaining to existing litigation in the matter of San Juan Hills Golf Club, LP. vs. City of San Juan Capistrano. OC Superior Court Case No. 30-2014-00742347. d. Pursuant to Government Code Section 54956.8, the City Council met with its Real Property Negotiators (Ben Siegel, City Manager; and Jeff Ballinger, City Attorney) concerning the price and terms of payment concerning a 27.725 acre farm generally located at the northwest corner of Alipaz and Camino Del Avion (South Coast Farms). e. Pursuant to Government Code Section 54956.8, the City Council met with its Real Property Negotiators (Ben Siegel, City Manager; and Jeff Ballinger, City Attorney) concerning the price and terms of payment concerning a 2.46 acre portion of property located in the corner of APN 125-172-07 (The Oaks). 1 1/12/2017 f. Pursuant to Government Code Section 54956.9 (a), (d)(2), and (d)(4), the City Council conferred with Legal Counsel to discuss significant exposure to litigation (1 item). g. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council conferred with legal counsel pertaining to existing litigation in the matter of Southwest Voter Registration Education Project, et al. v. City of San Juan Capistrano, OC Superior Court Case No. 30-2016-00832243-CU-CR- CJC. ANNOUNCEMENT OF CLOSED SESSION ACTIONS: Mayor Ferguson reported for Closed Session Item E that the City is working in close partnership with The Oaks in regard to the open space transition process. The Oaks is working diligently with the City to do everything possible to maintain equestrian paddocks on the property after the transition, and thanked The Oaks for hearing the concerns of the City Council and community members, and working with the City Council to ensure that this important community asset is available for all to enjoy. Jeff Ballinger, City Attorney, reported for Closed Session Item G that the City Council voted unanimously 5-0 not to appeal the case. ADJOURNMENT: There being no further business, Mayor Ferguson adjourned the meeting to the Adjourned Regular Meeting of Thursday, January 12, 2017, at 5:00 p.m. for a public Business Session, in the City Council Chamber.
