SAN JUAN CAPISTRANO CITY COUNCIL
SPECIAL MEETING
Mayor Patterson called the November 1, 2016, Special Meeting of the City Council to
order at 3:35 p.m. in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS PRESENT: Mayor Pam Patterson, Esq., Mayor pro tem
Kerry K. Ferguson, and Council Members Derek Reeve and Sam Allevato.
COUNCIL MEMBERS ABSENT: Council Member John M. Perry.
ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON CLOSED
SESSION ITEMS:
• Dr. Julie Ryan Johnson, San Juan Capistrano Equestrian Coalition spoke on
Closed Session Item A; and, Hansje McHugh, City resident spoke on
Closed Session Item A.
CLOSED SESSION (610.85)
A Closed Session was held for the following purposes, as authorized by statute:
a. Pursuant to Government Code Section 54956.9(d)(2), the City Council conferred
with legal counsel pertaining to a significant exposure to litigation. (1 item)
b. Pursuant to Government Code Section 54956.9(a) & (d) (1), the
City Council conferred with legal counsel pertaining to existing litigation in the
u matter of Hootan Daneshmand; Lauri McIntosh; and Brian Montgomery, on behalf
of themselves and all those similarly situated vs. City of San Juan Capistrano; and
does 1-20. OC Superior Court Case No. 30-2016-00829167-CU-BC-CXC.
C. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Ben Siegel City Manager; and Jeffrey Ballinger,
City Attorney) concerning the price and terms of payment concerning certain real
property located at La Novia and San Juan Creek Road (APN: 666-013-03, APN:
666-013-06, APN:666-042-10, and APN:666-042-11). Negotiating party:
Liz Bridgford.
d. Pursuant to Government Code Section 54956.9(a), the City Council conferred
with legal counsel pertaining to the administrative proceedings in the matter of the
Application of San Diego Gas and Electric Company for a Certificate of Public
Convenience and Necessity for the South Orange County Reliability
Enhancement Project (CPUC Application No. 12-05-020).
e. Pursuant to Government Code Section 54957.6, the City Council conferred with
its labor negotiators (City Council Sub-Committee) as to salary, compensation and
terms of employment of an unrepresented employee. The affected unrepresented
employee is the City Clerk.

f. Pursuant to Government Code Section 54956.9(a) & (d) (1), the
City Council conferred with legal counsel pertaining to existing litigation in the
matter of Save Our Historic Town Center, Mark Nielsen, Kenneth E. Friess, and
Robert J. Williams vs. City of San Juan Capistrano, at. al. OC Superior Court
Case No. 30-2014-00760231.
ANNOUNCEMENT OF CLOSED SESSION ACTIONS:
Council Member Allevato recused himself from Closed Session Item D, due to
the proximity of the powerlines from the San Diego Gas and Electric Company's
South Orange County Reliability Enhancement Project to his neighborhood.
Jeff Ballinger, City Attorney, announced that the City Council discussed all the items
listed on the Closed Session Agenda, and stated that there were no reportable actions.
He also announced that at the last City Council meeting of October 18, 2016, the
City Council gave direction to place at its November 1, 2016, meeting one item for
discussion pertaining to legal issues regarding the Riding Park, and to bring the item to
an open session at its November 15, 2016, meeting; however, in light of Council Member
Perry's absence, the City Council will be having a Closed Session item on the matter at
its November 15, 2016, meeting, and an open session item at its December 6, 2016,
meeting.
ADJOURNMENT:
There being no further business, Mayor Patterson adjourned the meeting to
Tuesday, November 1, 2016, at 5:00 p.m. for public Business Session, in the
City Cc ncil Chamber.
