COUNCIL POLICY Subject: Effective Policy Page Date Number COMMISSION/COMMITTEE ETHICS TRAINING 1 of 1 8/6/2008 213 It is a policy of the City Council to support Ethics Training requirements established by Assembly Bill 1234. Therefore, all appointed members to San Juan Capistrano standing Commissions and Committees who by policy are reimbursed for meeting attendance or expenses or receive any form of compensation for their service, shall complete all state mandated ethics training requirements and file certificate of completions with the City Clerk within established deadlines. The following procedures will be followed for all those required to complete state mandated ethics training within the established deadline: 1. The City Clerk shall report non-compliance status within 5 working days of the compliance deadline to the following offices: a. City Council Members: Notified by written correspondence with copies to the City Manager, City Attorney, and Commission/Committee Secretary. b. Finance: All meeting attendance reimbursement shall cease during a period of non-compliance. Reimbursement may resume (but not paid during the period of non-compliance) when compliance is obtained. 2. Noncompliant commission/committee members may not attend conferences or training (except ethics training) at the City's expense during the period of non- compliance. 3. Should noncompliance continue for 30 days, without substantiated extenuating circumstances such as illness, disability, family tragedy, etc. the City Clerk is directed to bring the matter to the City Council to consider removing the commissioner/committee member from office. a. Substantiation: Commission/Committee members may contact a City Council Member, Commission Secretary, or the City Clerk with substantiation of extenuating circumstances. Training deadlines may be temporarily postponed for noncompliant commission/committee members who are temporarily unable to fulfill their duties, including attending scheduled meetings, due illness, disability, family tragedy, and such that prevent completing training. Training must be completed within 30 -days of returning to service.
