CCP101 rehearingsCITY OF SAN JUAN CAPISTRANO COUNCIL POLICY Subject: Effective Policy Page Date Number REHEARINGS FROM CITY COUNCIL 1 of 1 4/6/93 101 It is a policy of the City Council that anyone desiring a rehearing concerning any decision of the City Council shall be required to submit a written request to the City Council for such consideration. The request shall be in the form of a letter. The letter shall include the following: a. The subject being appealed. b. Specific reasons for the appeal. The nature of any new evidence must be presented for the City Council to determine that this new evidence could not, with reasonable diligence, have been presented at the first hearing. c. The address or description of property involved, if applicable. d. The date of the City Council=s original action. e. Your name, address and telephone number. This policy is not intended to imply that a rehearing will be granted in every case. Rehearings will be held only in those cases of great hardship. Any letter must be received by the City Council no later than 21 calendar days after the City Council=s initial decision on an item. If an individual City Council Member concurs with the request and believes there may be new evidence that could not, with reasonable diligence, have been presented at the first hearing, the Council Member will request concurrence from a majority of the Council Members at a City Council meeting to agendize reconsideration of the decision. If a majority of the City Council does not agree that there is sufficient evidence to warrant reconsideration of the request, the request will not be considered. An item receiving majority City Council support will be referred to staff, who will prepare the agenda item in accordance with timeliness for the submittal of agenda items as outlined in Administrative Policy Number 311. ###
