CCP008 annexations CITY OF SAN JUAN CAPISTRANO COUNCIL POLICY Subject: Effective Policy Page Date Number ANNEXATION POLICY 1 of 1 2/18/86 008 The City Council established a non-aggressive annexation posture by resolution. Said policy was reviewed and reaffirmed by the City Council on February 18, 1986, by Resolution No. 86-2-18-3. This resolution provides: It is a policy of the City Council that the City shall begin annexation proceedings at the appropriate time whenever an area meets any one of the following conditions: 1. When the area is within the boundaries that are served by the Capistrano Valley Water District; 2. When an area requires sewer services from the City of San Juan Capistrano; 3. When the area is within the sphere of influence of the City of San Juan Capistrano; 4. When an area with no established sphere of influence requests annexation consideration from the City in a manner consistent with law. In addition to the foregoing, it shall be the policy of the City Council to require an election of the residents of the unincorporated area desiring to be annexed to the City and to submit consideration of the annexation request to the voters of San Juan Capistrano as an advisory measure. Any such measure submitted to the voters of San Juan Capistrano shall be done so in conjunction with a regularly scheduled election. Refer to attached resolution for specifics of the policy. 4 RESOLUTION NO. 86-2-18-3 ANNEXATION POLICY A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ESTABLISHING CRITERIA AND ADOPTING POLICY RELATING TO THE ANNEXATION OF TERRITORY TO THE CITY WHEREAS, the City Council has heretofore, by Resolutions No. 70-1-22-1 and 75-4-2-6 , determined that the City should undertake all necessary and proper measures to determine whether the areas of the Capistrano Valley Water District lying outside of the boundaries of the City can and should, in accordance with sound municipal growth and the will of the residents, be annexed to the City and established conditions under which said annexations should proceed; and, WHEREAS, LAFCO has adopted partial spheres of influence for the City in the north and west San Juan Capistrano area, parts of which have been recently annexed to the City; and, i WHEREAS, subsequently, in November 1974 , LAFCO adopted a policy of requiring that properties annexed to a special district be also annexed to an adjacent city where practicable and desirable to provide efficient governmental services; and, WHEREAS, the County of Orange has encouraged unincorporated communities of the County to consider annexation to existing cities as an alternative to incorporation or the formation of community service districts; and, WHEREAS, residents of unincorporated communities adjacent to the City of San Juan Capistrano have expressed an interest in annexation to the City and are considering annexation as a viable alternative to incorporation or the formation of community service districts; and, WHEREAS, tho annexation of one or more of these existing unincorporated communities to the City of San Juan Capistrano would result in a significant population and geographic increase of the City; and, WHEREAS, this City Council believes that in order to ensure orderly municipal growth and to preserve and maintain community values and the quality of life within the community, that there should be an annexation policy with certain established criteria including continuance of the City' s non-agressive annexation posture. -1- 478 . NOW, THEREFORE, BE IT RESOLVED, that the following shall be the annexation policy of the City of San Juan Capistrano. The City of San Juan Capistrano shall begin annexation proceedings at the appropriate time whenever an area meets any one of the following conditions: (1) When the area is within the boundaries that are served by the Capistrano Valley Water District; (2) When an area requires sewer services from the City of San Juan Capistrano; (3) When the area is within the sphere of influence of the City of San Juan Capistrano; (4) When an area with no established sphere of influence requests annexation consideration from the City in a manner consistent with law; "Appropriate time" shall be construed to be any one of the following: (1) When an annexation petition is received from owners/voters as provided by law; l (2) Prior to development; (3) When the City determines that an inhabited area can be more effectively served by the City, and in accordance with sound municipal growth. p In addition to the foregoing, when it has been determined by the City that the annexation of an inhabited area with a large population or size may be of significant concern or interest to the existing residents of the community, it shall be the policy of the City to require an election of the residents of the unincorporated area desiring to be annexed to the City and to submit consideration of the annexation request to the voters of San Juan Capistrano as an advisory measure. Any such measure submitted to the voters of San Juan Capistrano shall be done so in conjunction with a regularly scheduled election.
