16-0719_CC_Minutes_Special Meeting MINUTES July 19, 2016 SAN JUAN CAPISTRANO CITY COUNCIL SPECIAL MEETING Mayor Patterson called the July 19, 2016, Special Meeting of the City Council to order at 3:04 p.m. in the City Council Chamber. ROLL CALL COUNCIL MEMBERS PRESENT: Mayor Pam Patterson, Esq., Mayor pro tem Kerry K. Ferguson, and Council Members Derek Reeve, John M. Perry and Sam Allevato. COUNCIL MEMBERS ABSENT: None. ORAL COMMUNICATIONS/PUBLIC COMMENT ON CLOSED SESSION ITEMS: None. CLOSED SESSION (610.85) A Closed Session was held for the following purposes, as authorized by statute: a. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council conferred with legal counsel pertaining to existing litigation in the matter of Vermuelen Ranch Center, LLC vs. City of San Juan Capistrano. OC Superior Court Case No. 30-2015-00799138-CU-EI-CXC. b. Pursuant to Government Code Section 54956.8, the City Council met with its - Real Property Negotiators (Ben Siegel City Manager; and Jeffrey Ballinger, City Attorney) concerning the price and terms of payment concerning certain real property located at 29943 Camino Capistrano (Roger Y. Williams Swanner House) Negotiating parties: (Hamilton Oaks, LLC; and Jim Adam). C. Pursuant to Government Code Section 54956.9 (a), (d)(2), and (d)(4), the City Council conferred with Legal Counsel to discuss significant exposure to litigation (1 item) (Verizon Wireless) (32391 Camino Capistrano). d. Pursuant to Government Code Section 54956.8, the City Council met with its Real Property Negotiators (Ben Siegel, City Manager; and Jeff Ballinger, City Attorney) concerning the price and terms of payment concerning a 27.725 acre farm generally located at the northwest corner of Alipaz and Camino Del Avion (South Coast Farms). e. Pursuant to Government Code Section 54956.9 (a), (d)(2), and (d)(4), the City Council conferred with Legal Counsel to discuss exposure to potential litigation (1 item). f. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council conferred with legal counsel pertaining to existing litigation in the matter of Hootan Daneshmand; Lauri McIntosh; and Brian Montgomery, on behalf of themselves and all those similarly situated vs. City of San Juan Capistrano; and does 1-20. OC Superior Court Case No. 30-2016-00829167- CU-BC-CXC. 1 7/19/2016 ANNOUNCEMENT OF CLOSED SESSION ACTIONS: Jeff Ballinger, City Attorney, announced that Council Member Reeve recused himself from Closed Session Item A in abundance of caution because of the location of his residence from the property that is subject to litigation.
