SAN JUAN CAPISTRANO CITY COUNCIL
SPECIAL MEETING
Mayor Patterson called the May 17, 2016, Special Meeting of the City Council to order
at 3:36 p.m. in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS PRESENT: Mayor Pam Patterson, Esq., Mayor pro tem
Kerry K. Ferguson, and Council Members Derek Reeve, John M. Perry, and
Sam Allevato.
COUNCIL MEMBERS ABSENT: None.
ORAL COMMUNICATIONS/PUBLIC COMMENT ON CLOSED SESSION ITEMS:
• Steve Behmerwohld, City resident.
CLOSED SESSION (610.85)
A Closed Session was held for the following purposes, as authorized by statute:
a. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Ben Siegel, City Manager; and
Jeff Ballinger, City Attorney) concerning the price and terms of payment
concerning a 2.46 acre portion of property located in the corner of
APN 125-172-07 (The Oaks).
b. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Ben Siegel, City Manager; and
Jeff Ballinger, City Attorney) concerning the price and terms of payment
concerning a 27.725 acre farm generally located at the northwest corner of
Alipaz and Camino Del Avion (South Coast Farms).
C. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Ben Siegel, City Manager; and
Jeff Ballinger, City Attorney) concerning the price and terms of payment
concerning certain real property located at APN 124-160-55 Commercial
Property (31776 EI Camino Real).
d. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Ben Siegel, City Manager; and
Jeff Ballinger, City Attorney) concerning the price and terms of payment
concerning certain real property located at APN 124-202-46.
e. Pursuant to Government Code Section 54956.9 (a), (d)(2), the
City Council conferred with Legal Counsel to discuss anticipated litigation
(1 item) (Threat of litigation Regarding the Ortega Highway Vacation).

f. Pursuant to Government Code Section 54956.9 (a), (d)(2), and (d)(4), the
City Council conferred with Legal Counsel to discuss exposure to potential
litigation (1 item).
ANNOUNCEMENT OF CLOSED SESSION ACTIONS: None.
ADJOURNMENT:
There being no further business, Mayor Patterson adjourned the meeting to
Tuesday; ay 17, 2016, at 5:00 p.m. for public Business Session, in the City Council
Chamber.
