OVERSIGHT BOARD TO THE SUCCESSOR AGENCY OF THE
SAN JUAN CAPISTRANO COMMUNITY REDEVELOPMENT AGENCY
SPECIAL MEETING
BUSINESS SESSION
Chair Freese called the Special Meeting of the San Juan Capistrano Oversight Board to
the Successor Agency of the San Juan Capistrano Community Redevelopment Agency
at 3:02 p.m. Board Member Thomas led the Pledge of Allegiance.
BOARD MEMBERS PRESENT: Bruce Tatarian, Larry Thomas, Kim McCord and
Vice-Chair Kerr and Chair Freese.
BOARD MEMBERS ABSENT: Clark Hampton, and Lori Doll.
Agenda items are presented in the originally agendized format for the benefit of the
minutes' reader, but were not necessarily heard in that order.

CONSENT CALENDAR:
1. OVERSIGHT BOARD MINUTES — REGULAR MEETING OF JANUARY 9, 2013,
NOT APPROVED DUE TO LACK OF MAJORITY VOTE.
Board Action: Moved by Vice-Chair Kerr, seconded by
Board Member Thomas, with Board Member Doll and Board Member Hampton
absent, and Board Member McCord and Chair Freese abstained to approve.
Motion fails.

THE RECOGNIZED OBLIGATION PAYMENT SCHEDULE FOR THE PERIOD
FROM JULY 1, 2013, THROUGH DECEMBER 31, 2013, (ROPS 13-14A) AND
AUTHORIZING CERTAIN OTHER ACTIONS PURSUANT TO CALIFORNIA
HEALTH & SAFETY CODE SECTION 34181(g) (330.20)
Cindy Russell, Finance Officer, provided a PowerPoint presentation and
responded to questions. �Q

Board Action: Moved by Board Member Tatarian, seconded by Board Member
Thomas, 5-0 with Board Member Hampton and Board Member Doll absent to
adopt Oversight Board Resolution 13-02-27-01 entitled, "A RESOLUTION OF
THE OVERSIGHT BOARD TO THE SUCCESSOR AGENCY OF THE SAN
JUAN CAPISTRANO COMMUNITY REDEVELOPMENT AGENCY APPROVING
A RECOGNIZED OBLIGATION PAYMENT SCHEDULE FOR THE PERIOD
FROM JULY 1, 2013, THROUGH DECEMBER 31, 2013, (ROPS 13-14A) AND
AUTHORIZING CERTAIN OTHER ACTIONS PURSUANT TO CALIFORNIA
HEALTH & SAFETY CODE SECTION 34181(g)," with direction to amend the
resolution as follows:
• Add language to Exhibit A, page 6, lines 17 and 18 under
Notes/Comments "...and payments being made."
• Make estimates on the higher side as opposed to the lower side where it
makes sense to assure that sufficient funds are received to pay
obligations.
• Add as many lines as necessary to include obligations that are still in
question pending the Finding of Completion (specifically lines 17 and 18),
or any other items that are necessary.

2. LETTER TO THE DIRECTOR OF THE CALIFORNIA DEPARTMENT OF FINANCE,
APPROVED (400.80)
Cindy Russell, Finance Officer, provided an agenda report and responded to
questions.
Board Action: Moved by Chair Freese, seconded by Board Member McCord, and
carried 5-0 with Board Member Doll and Board Member Hampton absent to
approve a draft letter including questions and resolutions for response and
provide a date to respond by; and, authorize the Oversight Board Chair to sign
the letter to the Direct of the California Department of Finance (Copy of letter to
be sent to the City Council/Successor Agency and State Senator Mark Wyland).

California.
