ROLL CALL: COUNCIL MEMBERS PRESENT: Sam Allevato, Kerry K. Ferguson, John M. Perry, Mayor pro tem Pam Patterson, Esq. and Mayor Derek Reeve. COUNCIL MEMBERS ABSENT: None. PUBLIC COMMENT: None. CLOSED SESSION (610.85): A Closed Session was held for the following purposes, as authorized by statute: a. Pursuant to Government Code Section 54956.9 (a), (d)(2), and (d)(4), the City Council conferred with Legal Counsel to discuss exposure to potential litigation. (1 Item) b. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council conferred with legal counsel pertaining to existing litigation in the matter of San Juan Hills Golf Club, LP. vs. City of San Juan Capistrano. OC Superior Court Case No. 30-2014-00742347. C. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council conferred with legal counsel pertaining to threatened/pending litigation in the matter of Jeffrey Cotton, et al. vs. City of San Juan Capistrano, et al. d. Pursuant to Government Code Section 54957, the City Council met regarding the appointment or employment of a City Manager. BUSINESS SESSION: Mayor Reeve called the Special Meeting of the City Council of the City of San Juan Capistrano to order at 3:00 p.m. in the City Council Chamber. Mayor Reeve led the Pledge of Allegiance. ROLL CALL: COUNCIL MEMBERS PRESENT: Sam Allevato, Kerry K. Ferguson, John M. Perry, Mayor pro tem Pam Patterson, Esq. and Mayor Derek Reeve. ANNOUNCEMENT OF CLOSED SESSION ACTIONS: Council Member Perry recused himself from Closed Session Item B due to being a former employee of the San Juan Hills Golf Club, and proximity to his residence. ORAL COMMUNICATIONS: • Stephen Wontrobski, Mission Viejo resident submitted an email; Kathleen Petersen, City resident; and Tina Auclair, City resident. ADMINISTRATIVE ITEMS: C1. CITY ATTORNEY a. MICHAEL ROUSH APPOINTED AS HEARING OFFICER FOR THE EL NIDO ESTATES RENT CONTROL HEARING; RESOLUTION NO. 15-07-09-01 ADOPTED RE-ESTABLISHING THE HOUSING ADVISORY COMMITTEE; AND $10,000 APPROPRIATED FROM THE GENERAL FUND RESERVES (430.70) Jeff Ballinger, City Attorney, provided an agenda report and responded to questions. • Public Comments: Art Oronoz, City resident. i Council Action: Moved by Council Member Ferguson, seconded by ! Council Member Allevato, and carried unanimously to appoint Michael Roush as Hearing Officer for the El Nido Estates Rent Control Hearing; RESOLUTION NO. 15-07-09-01 adopted entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, RE-ESTABLISHING THE HOUSING ADVISORY COMMITTEE;" and $10,000 appropriated from the General Fund Reserves. COUNCILMANIC ITEMS: 1. NANCY CAMPMAN, LAURA FREESE, AND JOANNE MARQUEZ APPOINTED TO THE HOUSING ADVISORY COMMITTEE, FOR A TERM ENDING MARCH 31, 2017, SUBJECT TO THE CITY COUNCIL ADOPTING A RESOLUTION RE-ESTABLISHING THE COMMITTEE (110.20) Mayor Reeve provided a report. • Public Comments: Matt Gaffney, City resident. r; 2 7/9/2015 Council Action: Moved by Council Member Allevato, seconded by Council Member Ferguson, and carried unanimously to appoint Nancy Campman, Laura Freese, and Joanne Marquez to the Housing Advisory Committee, for a term ending March 31, 2017, subject to the City Council adopting a resolution re-establishing the committee. 2. DISCUSSION AND POSSIBLE ACTION REGARDING CITY COUNCIL POLICY 011 — CODE OF ETHICS (610.30) — NO FORMAL ACTION TAKEN Council Member Perry provided a report. • Public Comments: Larry Kramer, City resident; Anna Dickinson, City resident; Matt Gaffney, City resident; Steve Behmerwohld, City resident; John Bernie, City resident; Kim McCarthy, City resident; Tina Auclair, City resident; and Shelly Barker, City resident.
