ROLL CALL: COUNCIL MEMBERS PRESENT: Roy L. Byrnes M.D., Derek Reeve, John Taylor, Mayor pro tem Larry Kramer and Mayor Sam Allevato. COUNCIL MEMBERS ABSENT: None. PUBLIC COMMENT: • Jim Vance, City resident spoke on Closed Session items C & D. CLOSED SESSION (610.85): A Closed Session was held for the following purposes, as authorized by statute: a. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council conferred with legal counsel pertaining to existing litigation in the matter of Capistrano Tax Payers Association vs. City of San Juan Capistrano. J OC Superior Court Case No. 30-2012-00594579. b. Pursuant to Government Code Section 54956.9 (a), (d)(2), and (d)(4), the City Council conferred with Legal Counsel to discuss anticipated litigation and/or may contemplate initiating litigation (2 items). c. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council conferred with legal counsel pertaining to existing litigation in the matter of San Juan Hills Golf Club, LP. vs. City of San Juan Capistrano. OC Superior Court Case No. 30-2014-00742347. d. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council confered with legal counsel pertaining to pending litigation in the matter of Capistrano Terrace Mobile Home Park Bankruptcy. Pursuant to Government Code Section 54956.96 (a) & (b), the City Council conferred with legal counsel to discuss existing litigation of South Orange County Wastewater Authority vs. Michael Demaree, 30-2013-00680142-CU-BC-CJC and related cross complaint. i 1 BUSINESS SESSION: Mayor Allevato called the Regular Meeting of the City Council of the City of San Juan Capistrano to order at 6:19 p.m. in the City Council Chamber. PRESENTATION AND DIRECTION PROVIDED REGARDING THE PHASE 1A PILOT PARKING MANAGEMENT PROGRAM (570.10) George Alvarez, City Traffic Engineer, provided a PowerPoint presentation and responded to questions. Deputy George Miller, responded to questions. • Public Comments: Tom Hribar, City resident. Council Action: Moved by Mayor Allevato, seconded by Council Member Byrnes and carried 3-2 with Mayor pro tem Kramer and Council Member Taylor opposed to ban overnight parking in the following streets: EI Camino Real to Forster Street; Camino Capistrano to Ortega Highway; Camino Capistrano to Del Obispo; and Forster Street from Camino Capistrano to EI Camino Real, and Yorba Street, from Camino Capistrano to EI Camino Real. Council Action: Moved by Mayor pro tem Kramer, seconded by Council Member Taylor, and carried unanimously to approve the preferred location for off-site habitat restoration located adjacent to the 2C Ranch Restoration Area for the Pacifica San Juan project to facilitate the implementation of the Special 4(d) Rule Interim Habitat Loss Mitigation Plan (IHLMP) required per United States Fish and Wildlife Services (USFWS) and California Department of Fish and Wildlife (CDFW) (collectively, "Resource Agencies"); and authorize the Development Services Director to notify the Resource Agencies of the City's support for this preferred option.
