1994-0202_CVWD MANAGEMENT EMPLOYEES_Memorandum of UnderstandingMEMORANDUM OF UNDERSTANDING (MOU) BETWEEN THE CAPISTRANO VALLEY WATER DISTRICT AND THE CAPISTRANO VALLEY WATER DISTRICT MANAGEMENT EMPLOYEES Section 1. Agreement This agreement is entered into by the parties on behalf of the Capistrano Valley Water District (District) and the Capistrano Valley Water District Management Employees (Management Employees) in accordance with the provisions of Section 3500-3510 of the California Government Code, otherwise known as the Meyers-Milias, Brown Act. All provisions of these agreement are effective upon adoption of this agreement by the District Board of Directors unless otherwise specified. Section 2. Recognition The District recognizes the Management Employees as the "recognized employee organization" for all full time executive, management and confidential employees except the General Manager, as outlined in section 802 of the Employee Handbook. Section 3. Rules and Regulations The personnel rules and regulations that govern wages, benefits, work conditions, standards of performance and conduct are contained in a Employee Handbook dated December, 1992 and as updated by general features of the General Employee MOU. This handbook replaces and supersedes all previous versions and previous MOUs. Changes agreed upon in this MOU through negotiations are to be incorporated with revised pages. Section 4. Salary and Benefits All benefits covered in the Employee Handbook, including those subject to renewal by the General Manager, such as the Wellness program, will be continued for the 1993/94 fiscal year. A general increase to the Management Employees salary ranges of 2.0% will be implemented effective July 1, 1993. Section 5. Management Incentive Program The cash payment aspect of the Management Incentive Program (MIP), section 904, will be discontinued for FY 93/94. For the "management level" supervisors, in lieu of cash payments additional vacation time will be granted based on achievement of goals. The amount of vacation time granted will be based on the percentages in the MIP applied to 2080 hours, based on the customary evaluation of their department mangager and the General Manager. These vacation hours are expected to be granted in early FY 94/95 for the FY 93/94 program. For the "executive level" man agers the MIP is completely discontinued for FY 93/94 and is replaced by a employer paid contribution to the Deferred Compensation Plan of 7%. This contribution would be prorated for partial service of less than the full fiscal year. • ' Section 6. Insurance The District agrees to continue the payment of health insurance premiums for employees and their eligible dependents. The rate to be paid by the District is the prevailing HMO rate for the coverage in place at 8/1/93. The District agrees to continue current coverage and payments for Dental and Vision insurance for employees and eligible dependents. Section 7. Term The term of this agreement runs through June 30, 1994. Section 8. Separability The provisions contained in this agreement have been bargained for and agreed to independently, and no particular clause, condition, or agreement is contingent or dependent upon any other therefore, should any such clause, condition, or agreement be held to be void or unenforceable, the remainder of the terms and conditions of this agreement shall remain in full force and effect.
