1991-0926_CVWD GENERAL EMPLOYEES_Memorandum of Understanding• MEMORANDUM OF UNDERSTANDING BETWEEN THE CAPISTRANO VALLEY WATER DISTRICT AND THE CAPISTRANO VALLEY WATER DISTRICT GENERAL EMPLOYEES SECTION 1. AGREEMENT This agreement is entered into by the parties on behalf of the Capistrano Valley Water District, hereinafter known as the "District," and the Capistrano Valley Water District General Employees, hereinafter known as "General Employees," in accordance with the provisions of Section 3500-3510 of the California Government Code, otherwise known as the Meyers-Milias, Brown Act. All provisions of this agreement are effective upon adoption of this agreement by the Board of Directors unless otherwise specified. SECTION 2. RECOGNITION The District recognizes the General Employees as the "recognized employee organization" for all non-management and non-confidential full-time employees. SECTION 3. RULES AND REGULATIONS It is understood and agreed that there exists within the District certain Personnel Rules and Regulations, departmental rules and regulations, and other written policies of the District which shall remain in full force and effect during the term of this agreement. SECTION 4. SALARY INCREASE The District agrees to grant a salary increase of five percent of base pay, effective on July 1, 1991, to all employees in the unit of representation. This increase shall be calculated by multiplying the approved salary steps by five percent rounded to the nearest dollar. SECTION 5. WORK BOOT REIMBURSEMENT The District will provide CAL/OSHA certified work boots and replace on an as needed basis as determined by a department manager, however, no less frequently than once a year. If an employee wishes to purchase a boot other than the model boot which would be provided by the District, the District will reimburse the employee for the cost of the boot up to a maximum of $100.00 provided the boot which is purchased is a CAL/OSHA certified steel toe work boot and the employee submits an appropriate receipt for the purchase. 1 If a special boot type is considered necessary by the department head, the District will proivde an allowance above the $100. SECTION 6. IRC SECTION 125 BENEFIT PLANS The District will investigate the interest of employees to provide an opportunity to participate on a voluntary basis in a Dependent Care Assistance Program (Section 129) under Internal Revenue Code Section 125, which allows employees to redirect part of their salary, before it is taxed, to be used for child, elderly and dependent care. The District will also investigate IRC section 106 for the feasibility of offering supplemental medical programs allowing premiums not provided by the District to be paid by the employee with pre-tax dollars. SECTION 7. MILEAGE REIMBURSEMENT Effective July 1, 1991, General employees shall receive a mileage reimbursement of $.275 per mile, in accordance with IRS standards. SECTION 8. MEDICAL INSURANCE COVERAGE The District hereby agrees to pay up to the following amounts for medical insurance: Exclusive Provider Coverage (EPO) Employee/month $173.88 Employee + 1 dependent per month $376.12 Employee + 2 dependents per month $501.17 For medical coverage through the Southern California Joint Powers Insurance Authority for the period of October 1, 1991 to June 30, 1992. Employees may choose the PPO option and pay the difference in cost. SECTION 9. CONTINUATION OF BENEFITS All fringe benefits previously granted and currently in effect to represented employees shall remain in full force and effect for fiscal years 1991-92 unless modified by the provisions of this agreement. 2 SECTION 10. SEPARABILITY The provisions contained in this agreement have been bargained for and agreed to independently, and no particular clause, condition, or agreement is contingent or dependent upon any other therefore, should any such clause, condition, or agreement be held to be void or unenforceable, the remainder of the terms and conditions of this agreement shall remain in full force and effect.
