1990-0918_CVWD GENERAL EMPLOYEES_Memorandum of Understanding1990-91 MEMORANDUM OF UNDERSTANDING BETWEEN CAPISTRANO VALLEY WATER DISTRICT AND CAPISTRANO VALLEY WATER DISTRICT GENERAL EMPLOYEES WHEREAS, the District's General Manager and authorized representative of the District's General Employees have met and conferred in good faith and have reached a mutual understanding concerning certain Employer-Employee matters. NOW, THEREFORE, it is mutally agreed by the duly authorized District and Employee representatives that the following shall constitute their P/Iemorandum of Understanding: SECTION 1. SALARY The District will provide a cost of living salary increase of 5.0% to all employees, retroactive to July 1, 1990. SECTION 2. SICK LEAVE BENEFITS V : The District will allow eligible employees to utilize a maximum of ninety-six (96) hours per year of accumulated sick leave with pay in the event of: 1) employee's presence is required elsewhere because of family medical and dental appointments, serious illness, disability or death of a member of the employee's immediate family; 2) official order to appear in court as a litigant or as a witness; and 3) accident or emergency involving employee or immediate family. SECTION 3. AUTOMOBILE ALLOWANCE/MILEAGE REIMBURSEMENT The District will increase mileage reimbursement from $0.21 to $0.26 per mile for miles driven on District business. SECTION 4. WELLNESS PROGRAM The District shall allocate Three Hundred Dollars ($300.00) to each employee per year as of July 1, 1990, which may be used for the following CAPISTRANO VALLEY WATER DISTRICT 1990-91 MEMORANDUM OF UNDERSTANDING GENERAL EMPLOYEES September 18, 1990 - Page Two wellness-related activities: health club memberships, exercise or other stress- reduction classes, annual physical examination, not covered by medical insurance, weight loss or smoking clinics, personal exercise equipment, or other uses not specifically named herein which may be approved by the General Manager. The employee shall state in writing his/her intended use of the funds and, upon approval by the General Manager or his designee, shall present a receipt for reimbursement or a bill for payment. SECTION 5. MODIFIED WORK SCHEDULE The District will allow employees to work a 44/36 flexible work schedule where the employee works 44 hours one week and 36 hours the next week, thereby working only nine (9) days in a two-week period. This is generally done by working four (4) nine (9) hour days and one (1) eight (8) hour day one week, and four (4) nine (9) hour days on alternate weeks. This work schedule is subject to the approval of the employee's Department head and the General Manager, and is contingent on staffing requirements and assurance that there will be no decrease in service level to the District's customers. SECTION 6. VACATION A. The District will allow an employee to transfer into the employee's Deferred Compensation Plan account, vacation hours accured in excess of eighty (80) hours, provided the employee has used at least forty (40) vacation hours during the last completed calendar year. This option will be available to the employee twice a year and hours will be transferred at a rate of 10096 of the employee's current wage rate at the time of transfer. All general employees with four (4) or more years of service to the District as of December 1, will receive a one-time yearly payment equal to 0.4% of their individual base salary. SECTION 7. CONTINUATION OF BENEFITS All fringe benefits previously granted and currently in effect to represented employees shall remain in full force and effect for fiscal year 1990-91, notwithstanding other provisions of the Memorandum. SECTIONS. SEPARABILITY The provisions contained in the Memorandum have been bargained for and agreed to independently and no particular clause, condition, or agreement is contingent or dependent upon any other; therefore, should any such clause, condition, or agreement be held to be void or unenforceable, the remainder of the terms and conditions of the Memorandum shall remain in full force and effect. SECTION 9. TERM OF MEMORANDUM This Memorandum of Understanding shall be in effect from July 1, 1990 to June 30, 1991.
