1989-1017_CVWD GENERAL EMPLOYEES_Memorandum of Understanding# 1989-90 MEMORANDUM OF UNDERSTANDING BETWEEN CAPISTRANO VALLEY WATER DISTRICT AND CAPISTRANO VALLEY WATER DISTRICT GENERAL EMPLOYEES WHEREAS, the District's General Manager and authorized representatives of the District's General Employees have met and conferred in good faith and have reached a mutual understanding concerning certain Employer-Employee matters. NOW, THEREFORE, it is mutually agreed by the duly authorized District and Employee representatives that the following shall constitute their Memorandum of Understanding for the period of time commencing July 1, 1989 through June 30, 1990: SECTION 1. SALARY The District will provide a cost of living increase of six percent (6%), effective July 1, 1989. However, as a result of the Classification and Compensation Study recommendations, adjustments to some specific position salary ranges need to be made. Due to these adjustments, the net salary increases to certain represented positions will be less than six percent (6%), as indicated below: Position Percentage of Increase J* Water Technician 11 3% Water Tecnician 111 3% Foreman 4% Mechanic 3% All other positions will receive the six percent (6%) increase, effective July 1, 1989. SECTION 2. HEALTH PLAN BENEFITS , ^ During the term of this Agreement, the District will continue to pay the full cost of employee and dependent Health Plan Benefits, now provided by the SCJPIA Program as outlined in their Schedule of Benefits that was implemented September 1, 1989. SECTION 3. VISION PLAN BENEFITS The District will pay the full cost of the employee and dependent Vision Service Plan to be effective November 1, 1989. The plan will be Plan A, no deductible, as provided by SCJPIA. Si CAPISTRANO VALLEY WATER DISTRICT 1989-90 MEMORANDUM OF UNDERSTANDING GENERAL EMPLOYEES - Page Two SECTION 4. WATER CHARGE Effective November 1, 1989, the District will no longer provide water at no charge to employees living within the District's service area. The District will pay a one-time amount, equal to one year's estimated water consumption charges to the employees affected by this change. This payment will be made by November 10, 1989. SECTION 5. SICK LEAVE A. Upon termination, retirement, or death, an employee or the employee's estate, shall be paid for a portion of the employee's unused sick leave in an amount computed as provided below: Percent of Unused Years of Service Sick Leave Paid For 2 but less than 15 50% 15 but less than 20 75% 20 or more 100% B. Once annually, during the month of December, at the employee's option, the District will make a cash payment for a portion of the employee's unused sick leave in excess of 396 hours, in an amount computed as provided above. SECTION 6. CONTINUATION OF BENEFITS All terms and conditions of employment for District employees previously agreed to and currently in effect shall remain in full force and effect for fiscal year 1989-90, notwithstanding other provisions of this agreement. SECTION 7. SEPARABILITY The provisions contained in this Memorandum have been bargained for and agreed to independently, and no particular clause, condition, or agreement is contingent or dependent upon any other; therefore, should any such clause, condition, or agreement CAPISTRANO VALLEY WATER DISTRICT 1989-90 MEMORANDUM OF UNDERSTANDING GENERAL EMPLOYEES - Page Three be held to be void or unenforceable, the remainder of the terms and conditions of this Memorandum shall remain in full force and effect. SECTION 8. TERM OF MEMORANDUM This Memorandum of Understanding shall be in effect from July 1, 1989 to June 30, 1990. DATED this /7// day of October, 1989. DISTRICT GENERAL MANAGER Ray A.
