1988-0831_CVWD MANAGEMENT EMPLOYEES_Memorandum of Understanding1988-89 MEMORANDUM OF UNDERSTANDING BETWEEN CAPISTRANO VALLEY WATER DISTRICT AND CAPISTRANO VALLEY WATER DISTRICT MANAGEMENT EMPLOYEES WHEREAS, the District's General Manager and authorized representatives of the District's Management Employees have met and conferred in good faith and have reached a mutual understanding concerning certain Employer-Employee matters. NOW, THEREFORE, it is mutually agreed by the duly authorized District and Management Employee representatives that the following shall constitute their Memorandum of Understanding for the period of time commencing July 1, 1988 through June 30, 1989. Section 1. Recognition Management Employees shall consist of permanent fulltime employees in the following classifications: Executive Management Class Controller Customer Service Manager District Engineer Management Class Secretary to the General Manager Section 2. Salary The District will provide a cost of living salary increase of four percent (4%) to the Controller, District Engineer, and Secretary to the General Manager, effective July 1, 1988. The four percent (4%) salary increases shall be implemented by advancing each employee eight (8) code steps on the Basic Compensation Plan. Section 3. Health Plan Benefits A. The District will continue to pay the full cost of Health Plan Benefits provided by the Principal Mutual Life Insurance Company (Principal) with contract modifications as outlined by Principal in their revised schedule of benefits to be CAPISTRANO VALLEY WATER DISTRICT 1988-89 MEMORANDUM OF UNDERSTANDING MANAGEMENT EMPLOYEES - Page Two effective September 1, 1988, including a change in deductible to $200 per person per calendar year, $600 per family per calendar year; a change in Med Network charges to $10 per visit and a change in Med Network prescription charges to $5 per prescription. B. Both the District and the Management Employees recognize that health insurance premium costs have risen disproportionately to other costs. The issue of health care costs extends beyond the workplace and is a concern of society as a whole. The District will participate with the City of San Juan Capistrano's Medical/Dental Review Committee to study health insurance costs and recommend program or provider changes. This study will occur during the course of this contract year in order for conclusions to be reached and recommendations made prior to the expiration of this agreement. If an alternate health plan provider is selected during the term of this agreement, which offers comparable health benefits at a cost lower than the following costs, the difference will be paid to the Management Employees. The formula by which these funds will be distributed will be mutually agreed upon by the District and the Management Employees at the time the change in health insurance providers is made: $137.74 for employee coverage $294.39 for employee plus one dependent $373.55 for employee plus two or more dependents Section 4. Dental Plan Benefits The District and Management Employees agree that the new Dental Plan provider effective October 1, 1988, shall be Delta Dental Plan, and the District will continue to pay the full cost of employee and dependent coverage. The $6000 life insurance policy now provided with the existing Traveler's Insurance Dental Plan will not be provided with the new Dental Plan. t CAPISTRANO VALLEY WATER DISTRICT 1988-89 MEMORANDUM OF UNDERSTANDING MANAGEMENT EMPLOYEES - Page Three Section 5. Holidays The District's Holiday schedule shall be revised by adding December 24th, Christmas Eve, and deleting September 9th, known as Admission Day, as designated District Holidays. Section 6. Vacation Accrual , Employees shall now accrue vacation leave per the following schedule: Length of Service Annual Hours Accrued 0-3 years 80 4-7 years 128 8-10 years 144 more than ten years 160 Section 7. Classification and Compensation Study In conjunction with the City of San Juan Capistrano, the District proposes to undertake a Classification and Compensation Study of the entire organization. The Employees agree to this expanded study. This study wUl be conducted by a qualified independent consultant and will be undertaken immediately. The District will consult with the Employees during the course of the study. Section 8. Continuation of Benefits All terms and conditions of employment for District Management Employees previously agreed to and currently in effect shall remain in ftdl force and effect for fiscal year 1988-89, notwithstanding other provisions of this agreement. Section 9. Separability The provisions contained in this Memorandum have been bargained for and agreed to independently, and no particular clause, condition, or agreement is contingent or dependent upon any other; therefore, should any such clause, condition, or agreement i CAPISTRANO VALLEY WATER DISTRICT 1988-89 MEMORANDUM OF UNDERSTANDING MANAGEMENT EMPLOYEES - Page Four be held to be void or unenforceable, the remainder of the terms and conditions of this Memorandum shall remain in full force and effect. Section 10. Term of Memorandum This Memorandum of Understanding shall be in effect from July 1, 1988 to June 30, 1989. DATED this 3ist day of August _, 1988.
