1985-0701_CVWD MANAMGEMENT EMPLOYEES_Memorandum of Understanding1985-86 MEMORANDUM OF UNDERSTANDING between CAPISTRANO VALLEY WATER DISTRICT and CAPISTRANO VALLEY WATER DISTRICT MANAGEMENT EMPLOYEES WHEREAS, the District's General Manager and authorized representatives of the District's Management Employees have met and conferred in good faith and have reached a mutual understanding concerning certain Employer-Employee matters. NOW, THEREFORE, it is mutually agreed by the duly authorized District and Management Employee representatives that the following shall constitute their Memorandum of Understanding: 1. SALARY The District will provide a cost of living salary increase of 4.9% to all management employees, effective July 1, 1985. 2. RETIRED EMPLOYEES MEDICAL/DENTAL INSURANCE A retired regular District Management employee shall continue to be a member of the District's medical/dental insurance program after the employee retires, if the employee makes a written request for such continuation prior to the employee's retirement date. The total cost of the premiums for the retired employee's medical/dental insurance shall be paid by the retired employee. For the purpose of eligibility for medical/dental insurance, the following definitions shall apply: (a) Retired Regular Employee is a District employee who receives an Orange County Employees Retirement System CAPISTRANO VALLEY WATER DISTRICT 1985-86 MEMORANDUM OF UNDERSTANDING Page Two pension in less than one hundred eighty consecutive calendar days after retiring from regular District employment, and who has at least sixty consecutive calendar months of regular District service. (b) Retirement Date shall mean the last day of continuous service for which the regular employee received compensation. A disability retirement does not qualify a retired regular employee for Retired Employee medical/dental insurance, unless the employee also meets the OCERS requirements for a non-disability retirement. 3. CONTINUATION OF BENEFITS All fringe benefits previously granted and currently in effect to represented employees shall remain in full force and effect for fiscal year 1985-86, notwithstanding other provisions of this Memorandum. 4. SEPARABILITY The provisions contained in this Memorandum have been bargained for and agreed to independently and no particular clause, condition, or agreement is contingent or dependent upon any other; therefore, should any such clause, condition, or agreement be held to be void or unenforceable, the remainder of the terms and conditions of this Memorandum shall remain in full force and effect. • CAPISTRANO VALLEY WATER DISTRICT 1985-86 MEMORANDUM OF UNDERSTANDING Ps^e Three 5. (b) Retired Elected Employee is an elected District official who leaves elected District service no earlier than January 1, 1986, and who has at least sixty consecutive calendar months of elected District service. (c) Retirement Date shall mean the last day of continuous service for which the regular or elected employee received compensation. A disability retirement does not qualify a retired regular employee for Retired Employee medical/dental insurance, unless the employee also meets the OCERS requirements for a non-disability retirement.
