(San Juan Hills) RECOMMENDATION: By Motion: Authorize the Mayor to sign the Quit Claim Deed. SITUATION - In July of 1990 the City (then acting as the Capistrano Valley Water District) entered into a development agreement with the developer of Tracts 13865, 13436, 13866, and 13437. Among other conditions the agreement allowed the Developer to demolish the existing Old Zone 2 pump station (Old Z2) and acquire the lana upon which it sat in exchange for constructing a New Zone 2 pump station (New Z2) and providing new property for the New Z2. The New Zone 2 was completed and accepted by the City on August 1, 2000 by Resolution No CVWD 00-8-1-1 (Attachment 1). The site of the Old Z2, in Tract 13436, is shown on Attachment 2, and the title report Attachment 3, shows the City of Sart Juan Capistrano to still be the owner of this property. The site of the New Z2, in Tract 13866, is shown on Attachment 4, and the title report Attachment 5, shows the City of San Juan Capistrano to be the owner of this property. Since the developer S.J. Hills, a California Limited Partnership, has constructed and delivered the pump station and land to replace the Old Z2, staff recommends that the City execute the Quit Claim Deed (Attachment 6) and return the property to the California limited partnership doing business as "S.J.
