For valuable consideration, receipt of which is hereby acknowl-
edged, We,
WATKINS and BROADDUS, a Partnership, composed
of ERVIN L. WATKINS and RONALD L. BROADDUS,
do hereby irrevocably offer, for a ten year period commencing on
the date hereinbelow scribed, to dedicate to the CITY OF SAN JUAN
CAPISTRANO an easement and right of way for STREET AND HIGHWAY
purposes in, on and over all that real property situated in the
City of San Juan Capistrano, County of Orange, State of Califor-
nia, described as follows:
"A 37.00 foot wide strip of land lying Easterly of and
contiguous to the Easterly line of the 250.00 foot wide
right of way conveyed to the Orange County Flood Control
District by deed recorded January 3, 1963, in Book 6380,
page 192 of Official Records; said 37.00 foot wide strip
being bounded on its Northerly and Southerly ends by the
respective boundary lines of the following described par-
cel:

All that certain land situated in the State of California,
County of Orange, partly within the City of San Juan
Capistrano, described as follows:
That portion of the Northerly 59-1/2 acres of that part of
the Pryor Homestead Tract in said Rancho which was allotted
to Rosa A. de Pryor by Final Decree of Partition rendered
in Case No. 1210 in the Superior Court of Orange County,
California, described as follows:
Commencing at the Southwesterly corner of said 59 -acre
tract above mentioned; thence along the Westerly line of
the land so allotted to Rosa A. de Pryor, North 170 57' 30"
East 300 feet; thence East 20 feet; thence North 17° 57' 30"
East 922.08 feet, more or less, to a point which is North
89° 45' East 20 feet from the Northwesterly corner of the
land so allotted to Rosa A. de Pryor; thence along the
Northerly line of the land so allotted to Rosa A. de Pryor,
North 890 45' East 1560.50 feet, more or less, to a point
in the Westerly line of the right of way of The Atchison,
Topeka and Santa Fe Railway Company, as said right of way
is shown on a Map filed in Book 2, page 33 of Record of
Surveys in the office of the County Recorder of Orange
County, California; thence along the Westerly line of the
right of way of said Railway Company, South 32° 33' West
1608.75 feet, more or less, to the intersection of the
Westerly line of the right of way of said Railway Company
with the Southerly line of the Northerly 59-1/2 acres of
that tract allotted to Rosa A. de Pryor mentioned above,
thence along the Southerly line of said 59-1/2 acre tract
North 800 18' West 1107.5 feet to the point of beginning."

It is mutually understood and agreed that the foregoing
offer may be accepted by Resolution of the City Council of said
City at any time within the first ten years following the date
of this instrument as hereinafter subscribed when and if said
property is required, in the opinion of the City Council, for
street and highway purposes and the construction of said street
impaovementthrough the total length of the property hereinbefore
described is actually commenced during said ten years. In the.
event said offer is not accepted or in the event said work of im-
pro vement is not diligently followed to completion prior to the
end of the eleventh year follo wing the date of this offer, the
same shall expire and become null and void and of no further effe
It is further understood and agreed that upon such accep-
tance by the City, a copy of the resolution of acceptance shall
be mailed or delivered to the then owners at the address shown on
the latest secured assessment roll of Orange County, and, within
60 days thereafter said owners shall remove any and all structures
located upon said strip of land herein described. In the event
such structures are not removed within said 60 days, the City may
cause the same to be removed and the cost thereof shall become a
lien upon property immediately adjacent thereto.
It is further understood and agreed that,this offer is
irrevocable 9nd shall be absolutely binding upon the undersigned
ov,mers and grantors, their heirs, administrators, successors and
assigns for the ten year period hereinabove set forth, commencing
upon the date of the executimn hereof.
