does hereby GRANT to the CITY OF SAN JUAN CAPISTRANO, a perpetual easement and right of way for
slope purposes in, on and over the real property in the City
of San Juan Capistrano, County of Orange, State of California, described as:
An easement for the purpose of containing a slope, if any, that is or may be required to
support the roadway of Del Obispo Road, a public highway in said city described as follows:
A strip of land 13.00 feet wide lying contiguous with and southerly of the southerly right
of way line of Del Obispo Road, said Del Obispo Road right of way being a strip of land
104.00 feet wide, lying 52 feet each side of a centerline shown on a map recorded in Book 76
Page 4 of Records of Surveys of said Orange County; said 13.00 foot wide strip being bounded
on the east by the westerly line of the land described as Parcel 101 in a deed to the Orange
County Flood Control District recorded in Book 6609 Page 371 of Official Records of said
Orange County; said 13.00 foot strip being bounded on the west by the easterly line of
Alipaz Street, as said line is shown on a Precise Alignment map on file in the offices of
the City of San Juan Capistrano.
The easement parcel herein granted and described is and shall be subject to being narrowed
and diminished by Grantor, his successors or assigns, by Grantor's construction of land fill
and/or retaining walls approved by the City Engineer of Grantee, and Grantor reserves the
right to beneficially use said easement parcel, subject to the roadway of Del Obispo Road
being supported to the satisfaction of Grantee.
