FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged,
GILBERT E. JONES and 14ILDRED K. JONES, Husband and Wife, as
point Tenants
do hereby GRANT to the CITY OF SAN JUAN CAPISTRANO, a perpetual easement
and right-of-way for storm drain purposes in, on and over the real
property in the City of San Juan Capistrano, County of Orange, State
of California, shown and described on Exhibit "A."
The Grantor named abovet Franciscan Plaza Investment Group, a California
Limited Partnership ("Franciscan")rand any others allowed by the City
of San Juan Capistrano ("City"), shall have the right to connect into
and with and to use in common with the others, the storm drainage
systems and facilities to be installed by Franciscan on the storm
drain easement area described on Exhibit "A"." Any such connection-,
effected by said Grantor, Franciscan and any others allowed by the
City shall be without cost or expense to any other parties.
The City shall maintain, operate, reconstruct, if necessary, and repair
the storm drainage facilities constructed and installed in said storm
drain easement area described on Exhibit "A" and in this connection
shall have the right to enter upon the property of the above named
Grantor in order to accomplish such maintenance, operation, reconstruction
and repair.

is hereby accepted by order of the City Council on August 2, 1988, and the grantee
consents to recordation thereof by its duly authorized officer.
