EASEMENT DEED
FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged,
San Juan Hills Estates, HOA ("GRANTOR')
does hereby grant to Capistrano Valley Water District, a public corporation ("GRANTEE"), a non-
exclusive easement and right-of-way in, over, under, upon, along, through and across the real
property, a portion of Lots 1 and A of Amended Map No. 1 of Tract 13866, situated in the City of
San Juan Capistrano, County of Orange, State of California, as described in Exhibit "A" and shown
on (sketch) Exhibit 'B" attached hereto and by this reference made apart hereof. Such easement and
right -0f --way shall be for water transmission purposes, including, without limitation, the right to enter
upon, pass, re -pass along said land; to lay, construct, reconstruct, remove, replace, renew, inspect,
maintain, repair, improve, relocate, fill or re -grade, and otherwise use water pipelines and facilities;
to deposit tools, implements and other materials during said work, together with such connections,
structures and facilities incidental thereto.
The rights acquired herein shall be subject to the right of the fee owner its successors and assigns, to
reasonably use the surface of the easement area for such purposes which do not burden the rights
herein granted, and provided further that Grantor, its successors and assigns shall not, without the
prior written consent of the Capistrano Valley Water District:

1. Construct or place any street, alley, roadway or any other improvement or structure within
the easement area
2. Place upon or remove from the easement area any earth or material.

WATERLINE EASEMENTS
PARCEL 1: (Permanent Easement)
A strip of land 20.00 feet wide lying within those portions of Lots 1 and A of Amended Map No.
I of Tract No. 13866 in the City of San Juan Capistrano, County of Orange, State of California,
as shown on a map filed in Book 737, Pages 32 through 44, inclusive, of Miscellaneous Maps in
the office of the County Recorder of said County, said strip of land lying 10.00 feet on each side
of the following described centerline:
Beginning at a point in the right-of-way line of Paseo Crucero as shown on said map, said point
being on a non -tangent curve concave Easterly having a radius of 40.00 feet, a radial line to said
point bears South 8556'16" West; thence leaving said right-of-way line, South 7357'54" West
209.88 feet; thence North 3152'36" West 8.99 feet to a point hereinafter referred to as "Point
A'; thence continuing, North 3152'36" West 39.70 feet; thence North 60004'l 1" West 58.21 feet
to a point in the Westerly line of said Lot A, said point being South 0309'45" West 160.54 feet
along said Westerly line from the Northwest corner of said Lot A.
The sidelines of said strip are to be prolonged or shortened to terminate Easterly in the right-
of-way line of said Paseo Crucero and Westerly in the Westerly line of said Lot A.
