PARTIAL ASSIGNMENT OF DECLARANT RIGHTS
THIS PARTIAL ASSIGNMENT OF DECLARANT RIGHTS (this "Assignment") is made
and entered into by and between TAYLOR WOODROW HOMES, INC., a California corporation
("Assignor") and CITY OF SAN JUAN CAPISTRANO, a municipal corporation ("Assignee").
RECITALS:
A. Assignor, as the Declarant, caused that certain Amended and Restated (Supplemental
CC&R's) Notice of Annexation of Single Family Detached Project into San Juan Hills Estates (Phase
Seven) to be recorded on May 2, 1997, as Instrument No. 19970205491, as recorded on July 8, 1997,
as Instrument No. 19970321508 (collectively, the "Declaration"), in the Official Records of Orange
County, California ("Official Records").
B. Assignor is conveying to Assignee fee title to certain real property owned by
Assignor, located in the City of San Juan Capistrano, Orange County, California, as legally described
on ExhibitA attached hereto and incorporation herein by this reference ("Lot 48"), which is a
portion of the real property that was made subject to the Declaration.
C. Assignor desires to assign to Assignee all of the rights reserved to Assignor in the
Declaration, other than such obligations of Assignor provided for in the Declaration (the "Rights"),
and Assignee desires to accept such assignment of Rights from Assignor.
THEREFORE, Assignor hereby assigns to Assignee all the Rights that may be exercised by
Assignor with respect to Lot 48, effective as of the date of recordation of this Assignment. Assignee
hereby accepts such assignment of the Rights.
