hereby irrevocably offer to dedicate to the CITY OF SAN JUAN CAPISTRANO a perpetual easement and
right of way for STREET AND HIGHWAY purposes in, on and over all that real property situated in the
City of San Juan Capistrano, County of Orange, State of California, described as follows:
DESCRIPTION OF PARCEL:
That portion of Lot 5 of Tract No. 318 in the City of San Juan Capistrano, as shown on
a map thereof recorded in book 14, page 39, Miscellaneous Maps, records of said Orange
County, described as follows:
Beginning at a point in the Southwesterly line of said Lot 5, 402.92 feet Southeasterly
of the Southwesterly corner of said Lot 5; thence North 241 40' East 500 feet to the
true point of beginning; thence continuing North 24° 40' East 256.02 feet to a point in
the Northerly line of said Lot 5; thence South 821 10' East, 72.17 feet; thence South
370 O1' East 126 feet to the most Easterly corner of said Lot 5; thence South 240 40'
West along the Southeasterly line of said Lot 5, 244.16 feet; thence North 560 48'
West 182.01 feet to the true point of beginning;
EXCEPTING THEREFROM the Southwesterly 120 feet as measured along the Northwesterly
line.
DESCRIPTION OF EASEMENT:

It is mutually understood and agreed that the above offer
may be accepted by Resolution of the City Council of said City
whenever, in the judgment of said Council, the property is
needed for street and highway purposes.
It is further understood .and agreed that upon such accept-
ance by said City, it shall mail or deliver a copy of its resolution
of acceptance to the then owners at the address shown on the
latest secured .assessment roll in the County where said property
is located, and within 60 days thereafter said owners shall ra-
move any and all permanent structures that are affixed to the
above described strip of land, and if same are not removed
within said 60 day period said owners shall hold the City of San
Juan Capistrano free and harmless from any and all liability
for its destruction or removal of same.
It is further understood and agreed that this offer is irre-
vocable and shall be absolutely and perpetually binding upon
the undersigned owners, their heirs, successors and assign/s.
