follows: BEGINNING at the Northerly terminus of that certain course
shown as North 60 49' 34" West 129.84 feet in the Westerly line of the

Record of Surveys,records of said County; thence South 730 12' 19" East
364.95 feet; thence South 00 501 30" West 5.94 feet to the true point of
beginning; thence South 730 121 19" East 104.83 feet to a point on a non
tangent curve concave Easterly and having a radius of 1030.00 feet, a
radial to said point bears North 880 55' 12" West; thence Southerly 4.28

This AGREEMENT made and entered into this 10th day of
July,1972, by and between
The CITY OF SAN JUAN CAPISTRANO, a Municipal Corporation, hereinafter
referred to as:
"CITY"
AND
SOUTH COAST DEVELOPMENT CORPORATION, a California Corporation,
hereinafter referred to as:
WITNESSETH:
RECITALS:
"SOUTH COAST"
A. SOUTH COAST is developing certain property in the CITY
of San Juan Capistrano, known as Tract 7760, and in connection therewith
is obligated to install certain off-site drainage facilities.
B. The easement for such drainage facilities is currently being
negotiated with the fee owner. It is anticipated that said easement will be
acquired by SOUTH COAST prior to the recordation of the map of said Tract
7760.
C. In event that SOUTH COAST should fail to acquire said easement,
it is understood that the CITY is willing to acquire such easement through the
power of Eminent Domain, but is not willing to assume the costs thereof.
D. SOUTH COAST is willing to pay all costs for the acquisition of
said easement, including court costs and attorney's fees.
TERMS:
NOW, THEREFORE, in consideration of the mutual covenants herein
contained, it is agreed as follows:
1. SOUTH COAST will initiate and carry to conclusion any neccessary
action to acquire the easements for drainage purposes on, under, over anu acro,,
the real property of Melvin E. Rosenbaum and Lois Jean Rosenbaum.
2. In event that the CITY enters into action Linder Eminent Domain,
