RESOLUTION NO. 95-6-Z0-3
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, VACATING PUBLIC ACCESS WITHIN
PORTIONS OF AVENIDA LOS CERRITOS AND ACCEPTING REVISED
STREET AND UTILITY EASEMENTS FOR AVENIDA LOS CERRITOS
(ARCHITECTURAL CONTROL 89-3/SOUTH COAST CHRISTIAN
ASSEMBLY)
WHEREAS, the City is the holder of right-of-way for public street purposes over
Avenida Los Cerritos; and,
WHEREAS, Architectural Control 89-3, South Coast Christian Assembly, has been
conditioned to modify public access to Avenida Los Cerritos; and,
WHEREAS, said access modifications require that the City vacate its public access
rights over portions of Avenida Los Cerritos; and,
WHEREAS, said public access modifications require that South Coast Christian
Assembly acquire and offer to the City street and utility easements for the connection of Avenida Los
Cerritos to Rancho Viejo Road.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San
Juan Capistrano as follows:
The City Council hereby vacates the public street access rights over those portions of
Avenida Los Cerritos as shown on Parcels A, B and C on Exhibit "A", attached hereto and made a
part hereof. The City hereby retains the right for emergency access vehicles and public utilities within
Parcel C and utility purposes within Parcels A and B.
The City Council hereby accepts the easements for street and utility purposes as shown
on Exhibits B, C, D and E, attached hereto and made a part hereof.
The City Council hereby authorizes the Mayor and City Clerk to execute the
resolution and vacation easement and further directs the City Clerk to record said resolution and
easement documents with the Orange County Recorder's Office.

The City Council hereby allows and permits the Mission Cemetary to park overflow
vehicles in the vacated portion of Avenida Los Cerritos.

June 1995.
