A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, QUITCLAIMING A PUBLIC HIKING AND
EQUESTRIAN TRAIL EASEMENT WITHIN LOTS 50-54 OF TRACT
6381, AS DEDICATED ON FINAL TRACT MAP 6381 RECORDED IN
BOOK 633, PAGES 5-15 (STONERIDGE ESTATES/SILVER CREEK
SLIDE, INCORPORATED)
WHEREAS, the City of San Juan Capistrano is holder of an easement for Hiking
and Equestrian Trail purposes within Lots 50-54 of tract 6381 said trail having been
destroyed by a slope failure; and,
WHEREAS, the owners of said Lots, having formed the Silver Creek Slide
Corporation in order to repair said slope failure, have requested realignment of, and
have improved, a Recreational Trail adjacent to (northeasterly of) the subject trail; and,
WHEREAS, at their July 16, 2002 meeting, the City Council of the City of San
Juan Capistrano accepted a revised, realigned recreational trail easement within
property owned by Silver Creek Slide, Inc.; and,
WHEREAS, said Lot owners have requested that in exchange for dedication of
the revised easement to the City, that the City consider abandonment of the existing
Hiking and Equestrian Trail Easement within their Lots.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Juan
Capistrano, as follows:
SECTION 1. The City Council hereby finds and declares that the Hiking and
Equestrian Trail easements within Lots 50-54 of Tract 6381, as
dedicated on the Final Tract Map of Tract 6381, is no longer
necessary for public hiking and equestrian purposes and may be
Quitclaimed to the underlying property owners.
SECTION 2. The Mayor and City Clerk are hereby authorized to execute this
Resolution and the corresponding Quitclaim Deeds.
SECTION 3. The City Clerk is directed to forward the Quitclaim Deeds to the
Orange County Recorder.
