For valuable consideration, receipt of which is hereby acknowledged, (I, We)
PROVINCIAL PROPERTIES, INC., A CALIFORNIA CORPORATION
hereby irrevocably offer to dedicate to the CITY OF SAN JUAN CAPISTRANO a perpetual easement and
right of way for STREET AND HIGHWAY purposes in, on and over all that real property situated in the
City of San Juan Capistrano, County of Orange, State of California, described as follows:

It is mutually understood and agreed that the above offer
may be accepted by Resolution of the City Council of said City
whenever, in the judgment of said Council, the property is
needed for street and highway purposes.
It is further understood .and agreed that upon such accept-
ance by said City, it shall mail or deliver a copy of its resolution
of acceptance to the then owners at the address shown on the
latest secured assessment roll in the County where said property
is located, and within 60 days thereafter said owners shall re-
move any and all permanent structures that are affixed to the
above described strip of land, and if same are not removed
within said 60 day period said owners shall hold the City of San
Juan Capistrano free and harmless from, any and all liability
for its destruction or removal of same.
It is further understood and agreed that this offer is irre-
vocable and shall be absolutely and perpetually binding upon
the undersigned owners, their heirs, successors pand assigns.

An easement for road and publicutility purposes to be used in
common with others over a 40 -foot wide, more or less,strip of land
described as follows:
Commencing at a point on the center line of Ortega Highway as
described in deed to the County of Orange recorded October 22,
1913 in book 243, page 1 of Deeds, South 1°O1' East 161.45 feet
from the Southwest corner of said section; thence North 69°34'
East 708.50 feet along said center line of Ortega Highway to
Station No. 15, said Station No. 15 of said highway being the
Southwest corner of land described in a deed to Carl H. Hankey
and wife, recorded December 1, 1923 as Document No. 31790 in
Book 499 page 366 of Deeds of the Official Records of said Orange
County; said point also being the Southwest corner of land described
in a deed to George G. Laidlaw and wife, recorded August 18, 1928
in book 195, page 49 of Official Records; thence North 0°04'00"
West 1482.16 feet to the most Northerly corner of said land of
Laidlaw, said corner being the TRUE POINT OF BEGINNING, thence
continuing Northerly along the Westerly line of lands described
in said deed to Hankey; North 0°04'00" West 299.11 feet; thence

traveled road, a distance of 303.29 feet"; thence Northwesterly along
said Southerly Provincial Properties, Inc. deed line, the following
courses and distances; North 74°50'21" West 158.60 feet, North 60°13'51
West 54.08 feet (54.40 feet per said deed) to a 2" I.P. (3/4" I.P.
per said deed) which lies approximately midway between an existing
surfaced road and an old fence line which bears approximately
