For valuable consideration, receipt of which is hereby acknowledged, (I, We)

hereby irrevocably offer to dedicate to the CITY OF SAN JLtAN CAPI'STRANO a perpetual easement and
right of way for STREET AND HIGHWAY purposes in, on and over all that real property situated in the
City of San Juan Capistrano, County of Orange, State of California, described as follows:
That portion of Lot 4 of Tract No. 318, as shown in map recorded in
Book 14 page 39 of Miscellaneous Maps, records of Orange County, California
described as follows: Record of Survey 83/32 20 September 1965
Commencing at the Southwest corner of Lot 4, Tract No. 318 per M.M.
14-39, Records of Orange County, California; thence South 56°48'00" East
along the Southerly line of said Lot, a distance of 185.00 feet to the
TRUE POINT OF BEGINNING. Said point being the Southwest corner of the
Parcel as shown on Record of Survey in Book 83, Page 32, Records of said
County; thence North 24°40'00" East along the Westerly line of said Par-
cel, a distance of 749.21 feet to the Northerly line of said Lot; thence
South 71°30'00" East along the Northerly line of said Lot, a distance of
25.15 feet; thence South 24040'00" West, a distance of 712.41 feet to the
beginning of a curve concave to the East, having a radius of 15.00 feet;
thence Southerly along said curve, a distance of 21.33 feet thru an angle
of 81°28'00"; thence South 56°48'00" East parallel with the Southerly line
of said Lot and 30.00 feet measured at right angles Northeast of said line,
a distance of 148.69 feet to the Easterly line of said Parcel; thence South
24°40'00" West, a distance of 30.33 feet to the Southerly line of said Lot;
thence North 56°48'00" West, a distance of 186.89 feet to the point of
beginning.

It is mutually understood and agreed that the above offer
may be accepted by Resolution of the City Council of said City
whenever, in the judgment of said Council, the property is
needed for street and highway purposes.
It is further understood .and agreed that upon such a"c t-
ance by said City, it shall mail or deliver a copy of its resolution
of acceptance to the then owners at the address shown on the
latest securedassessment roll in the County when said property
is located, and within 60 days thereafter said owners shall re-
move any and all permanent structures that are affixed to the
above described strip of land, and if same are not removed
within said 60 day period said owners shall hold the City of San
Juan Capistrano free and harmless from any and all liability
- for its destruction or removal of same.
It is further understood .and agreed that this offer is irre-
vocable and shall be absolutely and perpetually binding upon
the undersigned owners, their heirs, successors and assigns.
