IRREVOCABLE OFFER TO CONVEY EASEMENT
For valuable consideration, receipt of which is hereby acknowledged, we
EDDY MEREDITH and VIOLET MEREDITH, husband and wife,
hereby irrevocably offer to dedicate to the City of San Juan Capistrano a perpetual
easement and right of way for EQUESTRIAN TRAIL purposes in, on and over all real
property situated in the City of San Juan Capistrano, County of Orange, State of
California, described as follows:
PARCEL 1. A 10 foot wide strip of land lying contiguous to and southerly of the north-
erly boundary lines of Lots 49, 50, 51, 52 and 53 of Tract 8319, recorded September 4,
1973 in Miscellaneous Maps of Orange County, California, in book 331 pages 15 to 18 in-
clusive, as said boundary lines are shown on a map filed in book 95 pages 11 to 18 in-
clusive, of Records of Surveys of said County of Orange. Exceptinq therefrom the right
of access to Via la Mirada, a public street.
PARCEL 2. A 10 foot wide strip of land lying contiguous to and southeasterly of the
northwesterly boundary lines of Lots 114, 115, 116, 117 and i18 of Tract 8087, recorded
September 4, 1973 in Miscellaneous Maps of Orange County, California, in book 331 pages
27 to 32 inclusive, as said boundary lines are shown on a map filed in book 95 pages
11 to 18 inclusive, of Records of Surveys of said Orange County.
PARCEL 3. A 10 foot wide strip of land lying contiguous to and southerly of the north-
er—Ty boundary lines of Lots 108, 109, 110, 111, 112 and 113 of Tract 8087, recorded
September 4, 1973 in Miscellaneous Maps of Orange County, California, in book 331 pages
27 to 32 inclusive, as said boundary lines are shown on a map filed in book 95 pages
11 to 18 inclusive, of Records of Surveys of said County of Orange. Excepting therefrom
the right of access to Via la Mirada, a public street.
It is mutually understood and agreed that this offer is made, and acceptance shall be by
Resolution of the City Council of Said City, subject to precedent conditions: (1) that
said City shall have officially adopted a Master Plan of Equestrian Trails including
the easement described herein, and (2) that said City is in the process of implementing
said Master Plan.
It is further understood and agreed that upon such acceptance by said City, it shall mail
or deliver a copy of its resolution of acceptance to the then owners at the address shown

on the latest secured assessment roll in the County where said property is located,
and within 60 days thereafter said owners shall remove any and all structures that
are affixed to the above described strip of land, and if same are not removed with-
in said 60 day period said owners shall hold the City of San Juan Capistrano free
and harmless from any and all liability for its destruction or removal of same.
It is further understood and agreed that this offer is irrevocable and shall be
absolutely and perpetually binding upon the undersigned owners, their heirs, suc-
cessors and assigns.
