The verified petition of CROCKER NATIONAL BANK, as Exec-
utor of the Estate of CARL M. LOFTIS, deceased, for Approval of
Compromise of Claims by Estate came regularly for hearing by the
court this date. Petitioner appeared by counsel Hitchcock, Bowman
& Schachter, by Douglas Butler.
The court finds, from proof made to the satisfaction of
the court:
1. Notice of the time and place of the hearing has been
duly given as required by law including notice to the heirs of the
deceased as named in Petition for Letters Testamentary and special
notice to Cooksey, Coleman and Howard in accordance with a request
filed herein.

1 2. Time for filing creditors' claims has expired.
2 3. Among the assets of the Estate is a twenty-seven and
3 one-half (27.5%) percent interest in Orange County Superior Court
4 Case No. 243274, City of San Juan Capistrano, A Municipal Corpor-
5 ation, vs. Sterling Hall, et al. which was an eminent domain action.
6 The decedent had been a party to the action prior to his death.
7 All the parties to the lawsuit have agreed to a compromise and
8 settlement subject to the approval of the Probate Court. The City
9 of San Juan Capistrano will pay the sum of $20,000.00 in. settlement
10 of the eminent domain action. The Estate will receive Twenty-seven
11 and one-half (27.5%) percent of the proceeds which equals $5,500.00
12 for its share of the eminent domain action.
13 4. It is to the advantage of the estate and all inter -
14 ested persons that the compromise and settlement as set forth in
15 the petition be approved.
16 IT IS ORDERED as follows:
17 1. The compromise and settlement of the action entitled
18 City of San Juan Capistrano, A Municipal Corporation, vs. Sterling
19 Holloway, et al., in the Orange County Superior Court, Case No.
20 243274 of which the Estate has a twenty-seven and one-half (27.5%)
21 oercent interest in the proceeds of the eminent domain action is
22 approved as follows:
23 The City of San Juan Capistrano shall pay the sum of
24 $20,000.00 in settlement of the eminent domain action. The Estate
25 will receive twenty-seven and one-half (27.5%) percent of the
26 proceeds or $5,500.00 for its share of the eminent domain action.
