It is mutually understood and agreed that the above offer
may be accepted by Resolution of the City Council of Said City
whenever, in the judgment of said 'Council, the property is
needed for RECREATIONAL
TRAIL PURPOSES.
It is further understood ,and agreed that upon such acce-t-
ante by said City, it shall mail or deliver a copy of its resolution
of acceptance to the then owners at the address shown on the
latest secured assessment roll in the County where said property
is located, and within 60 days thereafter sald owners shall rs-
move any and all permanent structures that are affixed to the
above described strip of land, and i1 same are not removed
within said 60 day period g:id owners shall hold the City of San
Juan Capistrano free and harmless from; any and all liability
for its destruction or removal of same.
It is further understood and agreed that this offer Is irre-
vocable and shall be absolutely and perpetually binding upon
the undersigned owners, their heirs, successors and assigns.

An easement for recreational trails over that portion of Tract 8325 per
map recorded in Book 332, Pages 17 - 19 inclusive, Miscellaneous Maps,
County Recorder, County of Orange, State of California, described as
following:
Beginning at the most Westerly corner of Lot 53 of said Tract 8325, also
being a point on the Southerly line of Ortega Highway as shown on said
Tract 8325; thence North 53011'15" East 4.66 feet along said Ortega Highway
to the True Point of Beginning; thence South 68030'47" East 344.74 feet to
a point in the Easterly line of said Lot 53, also being a point on a 123
foot radius curve concave Westerly, a radial through said point bearing
South 85027'38" East; thence Northerly along said Easterly line of Lot 53
along the above mentioned curve through a central angle of 16032109" an
arc length of 35.50 feet; thence tangent to said curve North 11059'47"
West119.88 feet to a tangent 123 foot radius curve concave Southwesterly;
thence along said curve through a central angle of 10047'34" an arc length
of 23.17 feet; thence leaving said last mentioned curve North 68030'47"
West 156.36 feet to the Northwesterly line of said Lot 53 also being the
Southerly line of Ortega Highway as shown on said Map 8325; thence South

the True Point of Beginning.
Excepting from the above described easement any portion of Lots 2, 3, and
