IRREVOCABLE OFFER TO CONVEY
EASEMENT
For valuable consideration, receipt of which is hereby acknowledged, (1, We)
WES H. KLUSMANN and GERTRUDE E. KLUSMANN, husband and wife, as Joint Tenants,
hereby irrevocably offer to dedicate to the CITY OF SAN JUAN CAPISTRANO a perpetual easement and
right of way for STREET AND HIGHWAY purposes in, on and over all that real property situated in the
City of San Juan Capistrano, County of Orange, State of California, described as follows:
That portion of Lot 5, Tract No. 3189 as shown on a map recorded in Book 14, at Page 399
of Miscellaneous Maps, records of Orange County, California, described as follows:
Beginning at a point in the Southwesterly line of said Lot 5 which said point lies South
561 48' 00" East 220.55 feet from the Southwesterly corner of said Lot 5; thence South
561 48' 00" East along said Southwesterly line, 182.37 feet to the Southeast corner of
land conveyed to Wes H. Klusmann and wife in deed recorded December 13, 1957, in Book
4135, Page 261 of Official Records of said County; thence North 211° 40' 00" East along
the Southeasterly line of said Klusmann land 755.30 feet to the Northeasterly line of
said Lot 5; thence North 821 10' 00" West along said Northeasterly line, 26.12 feet;
thence South 241 40' 00" West 696.23 feet along a line parallel with and 25.CO feet
Northwesterly of, measured at right angles, said Southeasterly line of Klusmann land,
to the beginning of a tangent curve concave Northerly and having a radius of 15.00 feet;
thence Southwesterly. Westerly and Northwesterly along the aro of said curve through
a central angle of 981 32' 00", a distance of 25.80 feet to a tangent intersection with
a line parallel with and 30.00 feet Northeasterly of, measured at right angles, said
Southwesterly line of Lot 5; thence North 561 48' 00" West 139.67 feet along said
parallel line to the Northwesterly line of said Klusmann land; thence South 241 40' 00"
West 30.34 feet to the point of beginning.
Subscribing Witness
It is mutually understood and agreed that the above offer
may be accepted by Resolution of the City Council of said City
whenever, in the judgment of said Council, the property is
needed for street and highway purposes.
It is further understood and agreed that upon such actcgt.-
ance by said City, it shall mail or deliver a copy of its resolution
of acceptance to the then owners at the address shown on the
latest secured assessment roll in the County where said property
is located, and within 60 days thereafter said owner shall re-
move any and all permanent structures that are affixed to the
above described strip of land, and If same are not removed
within said 60 day period szid owner shall hold the City of San
Juan Capistrano free and harmless froani any and all liability
for its destruction or removal of same.
It is further understood :and agreed that this offer is irre-
vocable and shall be absolutely and perpetually binding upon
the undersigned owners, their heirs, successors and assigns.
