QUITCLAIM OF EASEMENT
WHEREAS, by document entitled "Irrevocable Offer to
Convey Easement", recorded September 1, 1972, in Book 10308 at
Page 482, Official Records of Orange County, California, JOHN S.
ZELKO, JR. and BARBARA J. ZELKO offered to dedicate to the City
of San Juan Capistrano (hereinafter sometimes "the City") a
perpetual easement and right-of-way for street and highway
purposes over the real property hereinafter described, and
WHEREAS, the offer to dedicate described above has not
been accepted by the City, and the City does not want the
easement which is the subject thereof, and
WHEREAS, it is in the best interests of the City and of
the surrounding community that said easement not be created and
that the irrevocable offer to convey easement not be accepted by
the City.
NOW, THEREFORE, the City of San Juan Capistrano hereby
remises, releases and quitclaims to MARILYNN EILEEN KIRK and
WILLIAM L. KEELS, JR. as Trustees of the Keele 1974 Revocable
Trust Agreement, dated 10/4/74, all of its right, title and
interest in the real property situated in the City of San Juan
Capistrano, County of Orange, State of California described as
follows:
A non-exclusive easement for road purposes over those
portions of Section 5, Township 8 South, Range 7 West,
San Bernardino Meridian, in the City of San Juan
Capistrano, County of Orange, State of California,
according to an official plat of said land filed in the
District Land Office, October 17, 1887, included within
a strip of land 25.00 feet wide, the easterly line of
which is described as follows:

Beginning at a point on the northerly line of that
certain property described in the deed recorded April
13, 1920, in Book 358 page 354 of Deeds, said point
being South 660.00 feet and South 62 degrees 43' 00"
West 483.73 feet from a 2 -inch iron pipe marking the
Northwest corner of lot 2 in said Section 5; thence,
South 14 degrees 47' 00" East 849.99 feet to the true
point of beginning; thence, North 14 degrees 47' 00"
West 714.69 feet, the westerly line of said 25 foot
easement being lengthened or shortened to intersect
with the northerly and southerly lines of the property
of offerer.
It is the intention of the City by this instrument to
extinguish for itself, and for its successors and assigns, its
right to accept the offer of dedication hereinabove described.
