5776, PAGE 366 OF OFFICIAL RECORDS, RECORDS OF
ORANGE COUNTY, CALIFORNIA
Mr. and Mrs. Robert M. Forster grant to the City of San Juan Capistrano a license to
enter on to the property described in a Joint Tenancy Grant Deed recorded in Book 5776,
Page 366 of Official Records, Records of Orange County, California for construction
purposes.
This license is granted subject to the following conditions:
1. Permission to enter the property is granted for the sole purpose of miscellaneous
construction work to install or relocate utility lines, landscaping, irrigation systems,
paved driveway and other items which may be necessary to implement on said pro-
perty as shown on the improvement plans entitled, "Construction Plans for the
Improvement of the Intersection of Del Obispo Street and Camino Del Avion", on
file in the Office of the City Engineer, City of San Juan Capistrano, California.
2. The City of San Juan Capistrano agrees that Mr. and Mrs. Robert M. Forster are to
be free from all liability or loss by reason of injury to person or property, from
whatever cause, while exercising any right granted under this license, including any
liability for injury or death to the person or property of the City of San Juan Capis-
trano, their agents and employees. The City of San Juan Capistrano shall save
Mr. and Mrs. Robert M. Forster harmless from any and all liability, loss, costs, or
obligations on account of, or arising out of any such injury or losses however occur-
ring resulting from the use of any rights granted under this license.
3. It shall be the duty of the City of San Juan Capistrano to maintain the property in
its current condition and not to commit waste upon the property during construction.
