A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, VACATING AN EASEMENT FOR PUBLIC
STREET AND EQUESTRIAN PATH PURPOSES, ACCEPTED VIA
RESOLUTION 79-12-5-7, OFFER "C", WITHIN PARCEL 2 ONLY OF DIVISION
OF LAND 76-11, AS SHOWN ON A PARCEL MAP RECORDED IN BOOK 106,
PAGES 19 AND 20 (ALSO KNOWN AS PARCEL 3 OF PARCEL MAP 92-253,
RECORDED IN BOOK 283, PAGES 19-21) (EWLES)
WHEREAS, the City Council previously approved Resolution 79-12-5-7, accepting
Offer "C", an easement for public street and equestrian path purposes as offered on Parcel 2 of Parcel
Map Division of Land 76-11, recorded in Book 106, pages 19 and 20; and,
WHEREAS, the City Council now finds that the street purpose for said easement
(extension of Via Estelita) is no longer necessary; and,
WHEREAS, the City has accepted a Recreation Trail easement to satisfy the
equestrian path purposes.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San
Juan Capistrano as follows:
1. That the City Council does hereby vacate the easement for public street and
equestrian path purposes, Offer "C", within Parcel 2 only of Parcel Map Division of Land 76-11,
recorded in Book 106, pages 19 and 20, more particularly shown on Exhibit "A", attached hereto for
reference.
2. That the Mayor and City Clerk are authorized to execute the Resolution and
Vacation Deed.
3. That the City Clerk is directed to forward the Resolution and Deed to the
Orange County Recorder for recordation.
PASSED, APPROVED, AND ADOPTED this 2nd day of
May 1995.
