FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged,
CAPISTRANO ASCOT DEVELOPMENT, INC. (formerly Melford
Developments (California), Inc. nonexclusive
do hereby GRANT to the CITY OF SAN JUAN CAPISTRANO, a/terpetual easement and right of way for
construction and maintenance of a sanitary sewer pipeline in on and over the read property in the City
of San Juan Capistrano, County of Orange, State of California, described as:
.That portion of Lot 13 as shown on a map filed in Book 4, page 15 of Record
of Surveys in the office of the County Recorder of said Orange County, des-
cribed as follows:
A strip of land 20.00 feet wide, measured at right angles, lying 10.00
feet on each side of the following described easement centerline:
Commencing at the centerline intersection of Camino Las Ramblas and
Via California as shown on Map of Tract No. 10283, recorded in Book 467,
pages 47 and 48 of Miscellaneous Maps, records of said Orange County;
thence South 780 11' 10" West, 266.19 feet to a point in the Northeasterly
boundary of Parcel 1 as described in deed to City of San Juan Capistrano,
recorded in Book 9504, page 215 of Official Records of said Orange County;
thence North 110 48' 50" West, 55.00 feet to the most Northerly corner of
said Parcel 1; thence running Southwesterly along the Northwesterly
boundary of said Parcel 1, being an arc of a curve concave Southeasterly
and having a radius of 2055.00 feet, from a tangent line which bears
South 780 11' 10" West, through a central angle of 80 06' 46", an arc
distance of 290.98 feet to the True Point of Beginning of said easement
centerline; thence North 190 55 6 west along said easement centerline,
208.04 feet to the end of said easement centerline.
The sidelines of said easement terminate at the Northwesterly end
thereof on a line at right angles to said easement centerline, and at the
Southeasterly end thereof on said Northwesterly boundary'of Parcel 1.

Capistrano Ascot Development, Inc., hereby reserves unto itself,
its successors and assigns, together with the right to grant and trans-
fer the same, the right to use the surface of the real property covered
by the easement herein described and the right to use the underground
portions of such real property for the installation, construction,
maintenance, repair and use of pipelines, conduits and other utility
installations, roads, driveways, buildings, building footings and founda-
tions and other improvements; provided that such uses shall not unreason-
ably interfere with the use by the City of San Juan Capistrano of the
easement herein granted,
Capistrano Ascot Development, Inc., further reserves unto itself,
subject to the approval of the City of San Juan Capistrano, which approval
will not be unreasonably withheld, the right to raise or lower the grade
of the surface over the subject pipeline consistent with the design for
the use of the property.
By its acceptance of the easement herein granted, the City of San
Juan Capistrano agrees, on behalf of itself, its successors and assigns
and in favor of Capistrano Ascot Development, Inc., its successors and
assigns, that any excavation or other activity within the easement
herein described shall be conducted in such a manner as is reasonably
calculated to cause the least injury to the property adjacent to such
excavation or other activity, and that it will make all restoration
or repair which may be necessary or appropriate following any such
excavation or other activity in order to restore such property to as
near the same condition as it was in prior to such excavation or other
activity as is reasonably practicable (including, without limitation,
repair of any paved surfaces and restoration of landscaped areas).
