PARTNERSHIP DEED OF GIFT
CAPISTRANO AIRPORT AND INDUSTRIAL PARK, LTD., a Cali -
fornia limited partnership, acting through its general part-
ners, JULIAN WILLCOX and BRUCE F. WINTON, does hereby
dedicate and convey to the City of San Juan Capistrano, a
municipal corporation, that certain real property in the City
of San Juan Capistrano, County of Orange, State of California,
commonly known as the runway and taxiways of the Capistrano
Airport more fully described as follows:
That portion of the southwest quarter of the southwest quarter
of section 12 township 8 south, range 8 west of the San Bern-
ardino meridian, according to an official plat of said land
filed in the District Land Office April 12,1875, all in the
City of San Juan Capistrano, County of Orange, state of Calif-
ornia, described as follows:
Beginning at the intersection of the south line of said south-
west quarter of the southwest quarter (whichdas a bearing of
s89043022"W) with the southeast line of the Orange County Flood
Control right of way as described in deed recorded in Book 6228,
Page 342 of official records in the office of said County Record-
er, said southeast line being a curve concave southeasterly and
having a radius of 1875.00 feet, a radial to said point bears
N46038157"W; thence northeasterly 81.09 feet along said curve
through a central angle of 2028141" to the true point of begin-
ning thence N66028'36"E 250.88 feet; thence 52303112411E 100.00
feet; thence N66028136"E 1850.00 feet thence N23031124W 100.00
feet; thence N66028'36"E 172.12 feet to the north line of said
Lot 4 of the Daneri tract; thence along said north line
N8905814311W 187.75 feet to the southeast line of said Flood
Control District right of way; thence along said southeast line
56801912411W 1380.01 feet to the beginning of said curve in said
southeast line hereinabove described as having a radius of
1875.00 feet; thence southwesterly 736.13 feet along said curve
through a central angle of 22029140" to the true point of begin-
ning.
EXCEPT therefrom the north 50.00 feet of the south 460.00 feet
of the east 70.00 feet of said southwest quarter of the south
west quarter.
ALSO EXCEPT therefrom that portion included within Lot 4 of
the Daneri tract per map filed in Book 2 Page 22 of Record of
Surveys.

This conveyance is subject to the condition that the
property conveyed herein shall be used for airport purposes
only, maintained and used solely for airport runway and
taxiway purposes and open to the public. In the event that
the foregoing condition upon which this conveyance is made
ever should be broken, in whole or in part, or should the
property conveyed herein ever be used for purposes other than
airport runway and taxiway uses, open to the general public,
then the estate conveyed shall terminate and the grantor shall
have on behalf of itself, its successors and assigns, the
right of re-entry which it has reserved pursuant to the Common
Law and Sections 707,708 and 1046 of the California Civil Code.
This conveyance is further subject to covenants, conditions
and easements of record and that certain encumbrance recorded
as Document No. 25711 in Book 7363, pages 489 to 491 of Official
Records of Orange County, provided that CAPISTRANO AIRPORT &
INDUSTRIAL PARK, LTD., agrees to hold the City of San Juan Cap-
istrano free and harmless from any liability thereon.
