(1911 ACT) FOR VALUABLE CONSIDERATION, receipt of which is hereby ack- nowledged, CAPISTRANO ACRES MUTUAL WATER COMPANY, a California corporation, grant and convey to CITY OF SAN JUAN CAPISTRANO, a municipal corporation, an easement and right of way to install, construct, reconstruct, remove and replace, inspect, maintain, repair, improve and relocate a sewer pipe line with incidental appurtenances and connections in, on and under said real property hereinafter described on Exhibit "A", and to install, construct, reconstruct, inspect, maintain, repair, replace and improve lines parallel to said sewer line, and to construct manholes and service connection structures appurtenant to said sewer line; said easement shall lie in, under and over that certain parcel of land in the County of Orange, State of California, more particularly described on Exhibit "A" attached hereto and made a part hereof. Together with the right to enter upon and to pass and repass over and along said strip of land, and to deposit tools, implements and other materials thereon, by said City of San Juan Capistrano, its officers, agents and employees, and by persons under contract to construct said sewer line, and their employees, whenever and wherever necessary for the purpose of laying, constructing, recon- structing, renewing, inspecting, maintaining, repairing, enlarging, using and operating said sewer line. The City hereby covenants and agrees not to interfere, interrupt, or relocate any water lines belonging to the grantor that may lie within the easement area herein described, unless permission by the i grantor has been obtained BOOK7626 vAa= It is also further understood and agreed that through no negligence of the City will the said sewer line, crossing the real property of the grantor, in any way pollute, interfere, or interrupt the existing water producing facility located on said real property of the grantor. In the event the above mentioned sewer easement and the sewer line are abandoned by the City of San Juan Capistrano for a period of one year, the herein described easement will revert to the under- signed grantor, its heirs, successors or assigns. It is understood that the easement and rights of way above described shall be acquired subject to the rights of the owner, its successor and assigns, to use the surface and subsurface of the land within the boundary line of such easement and rights of way to the extent compatible with the fullandfree exercise of said easement and rights of way; provided, however, that: No buildings or structures of any kind shall be placed, erected or maintained thereon.
