FOR VALUABLE CONSIDERATION, receipt of which is hereby acknowledged,
CLARENCE R. BROWN
grant(s) and convey(s) to CITY OF SAN JUAN CAPISTRANO, a municipal
corporation, a perpetual easement and right of way to install,
construct, reconstruct, remove and replace, inspect, maintain,
repair, improve and relocate a sewer pipe line with incidental
appurtenances and connections in, on and under said real property
hereinafter described on Exhibit "A", and to install, construct,
reconstruct, inspect, maintain, repair, replace, improve and
relocate lines parallel to said sewer line, and to construct manholes
and service connection structures appurtenant to said sewer line,
which structures may extend above the surface of the ground; said
easement shall lie in, under and over that certain parcel of land
in the County of Orange, State of California, more particularly
described on Exihibit "A" attached hereto and made a part hereof.
Together with the right to enter upon and to pass and repass over
and along said strip of land, and to deposit tools, implements, and
other materials thereon, by said City of San Juan Capistrano, its
officers, agents and employees, and by persons under contract to
construct said sewer line, and their employees, whenever and wherever
necessary for the purpose of laying, constructing, reconstructing,
renewing, inspecting, maintaining, repairing, enlarging, using and
operating said sewer line.
It is understood that the permanent easement and rights of way
above described shall be acquired subject to the rights of the owner,
its successor and assigns, to use the surface of the land within
the boundary line of such easement and rights of way to the extent

compatible with the full and free exercise of said easement and
rights of way; provided, however, that: No buildings or structures
of any kind shall be placed, erected or maintained thereon.

All that certain land situated in the State of California, County of
Orange, City of San Juan Capistrano, described as follows:
That portion of the southwest quarter of Section 6, Township 8 South,
Range 7 West, S.B.B. & M., described as follows:
Beginning at the intersection of the center line of Ganado Road and the
old Ortega Highway, as shown on a Map filed in Book 27, page 8 of Record
of Surveys in the office of the County Recorder of Orange County,
California, said point being the most northerly corner of land described
in the deed to Arley H. Leek and wife, recorded December 24, 1954, in
Book 2905, page 363, Official Records; thence South 42° 02' 00" East
104.10 feet along the center line of said Ganado Road to an angle point
in the easterly line of said land of Leek; thence South 3° 20' 10" West
169.97 feet to an angle point in said land of Leek; thence South 63° 23'
00" West 173.56 feet along the southeasterly line of said land of Leek;
thence North 16° 33' 40" West 233.48 feet to a point in the center line
of said Old Ortega Highway, being the northwesterly line of said land
of Leek; thence North 61° 38' 00" East 80.43 feet to an angle point in
said center line and northwesterly line; thence North 55° 27' 00" East
110.65 feet to the point of beginning.

East 220.53 feet; thence North 0° 26' 25" West 874.59 feet to the
beginning of a tangent curve concave southeasterly having a radius of
160.00 feet; thence northerly and northeasterly along said curve through
