For valuable consideration, receipt of which is hereby acknowledged, (X We) C. JAMES ALLAN ,
a single man, as to an undivided one-half interest and ALBERT WILLIAM
BROWN and DIANE E. BROWN, husband and wife, as joint tenants, as to an
undivided one-half interest,
hereby irrevocably offer to dedicate to the CITY OF SAN JUAN CAPI'STRANO a perpetual easement and
right of way for STREET AND HIGHWAY purposes in, on and over all that real property situated in the
City of San Juan Capistrano, County of Orange, State of California, described as follows:
That portion of Section 5, in Township 8 South, Range 7 West, San Bernar-
dino Base and Meridian, described as follows:
Commencing at a point in the Northerly line of that certain property
described in the deed recorded April 13, 1920, in book 358, page 364,
Deeds, records of said Orange County, said point being South 660.00
feet; thence South 620 43' 00" West 483.73 feet from a 2 -inch iron pipe
marking the Northwest corner of Lot 2 in said Section 5; thence South
14° 47' 00" East 1679.99 feet; thence South 60° 35' 10" West 330.87
feet to the true point of beginning; thence continuing along said South-
westerly line 12.65 feet; thence North 38° 14' 00" West 530.00 feet;
thence South 380 40' 30" West 550.00 feet; thence South 60° 58' 00"
' East 25.36 feet; thence North 380 40' 30" East 481.30 feet to the begin-
ning of a tangent 15.00 foot radius curve, concave Southerly; thence
Southeasterly along the arc of said curve 29.61 feet through a central
angle of 113° 05' 30"; thence tangent to said curve South 38° 14' 00"
Southeast 809.94 feet to the beginning of a tangent 93.00 foot radius
curve, concave Southwesterly; thence Southeasterly along the arc of

R Is mutually understood and agreed that the above offer
may be accepted by Resolution of the City Council of said City
whenever, in the judgment of said Council, the property is
needed for street and highway purposes.
It is further understood .and agreed that upon such accept-
ance by said City, it shall mail or deliver a copy of its resolution
of acceptance to the then owners at the address shown on the
latest secured .assessment roll in the County where said property
is located, and within 60 days thereafter said owners shall re-
move any and all permanent structures that are -affixed to the
above described strip of land, and if same are not removed
within said 60 day period said owners shall hold the City of San
Juan Capistrano free and harmless from any and all liability
for its destruction or removal of same.
It is further understood ,and agreed that this offer is irre-
vocable and shall be absolutely and perpetually binding upon
the undersigned owners, their heirs,, ssuucccessors and assigns. G
