AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, AMENDING ARTICLE 12 OF CHAPTER 2 OF TITLE 2, OF
THE SAN JUAN CAPISTRANO MUNICIPAL CODE REORGANIZING THE
WATER ADVISORY COMMISSION INTO THE UTILITIES COMMISSION.
Whereas, on August 28, 2008, the City Council of the City of San Juan Capistrano
approved the reorganization of the Utilities Department; and
Whereas, the reorganized Utilities Department is responsible for water, recycled
water, sewer, and storm drain operations and maintenance; and
Whereas, the City Council desires to amend and expand the duties of the existing
Water Advisory Commission to include review and recommendations related to water,
recycled water, sewer, and storm drain operations and maintenance; and
Whereas, the City Council desires to revise the name of the Commission to Utilities
Commission to reflect the reorganization of the Utilities Department and the Commission's
expanded role.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Article 12 of Chapter 2 of Title 2 of the San Juan Capistrano Municipal
Code is replaced in its entirety with the following:
Article 12. Utilities Commission
Sec. 2-2.1201. Created.
A Utilities Commission for the City is hereby created.
Sec. 2-2.1202. Membership.
The Utilities Commission shall consist of five (5) members who are City residents.
Sec. 2-2.1203. Duties.
The Utilities Commission shall review and make recommendations to the City
Council concerning:
a. Water, recycled water, and sewer enterprise fund budgets;
b. Storm drain operating budget;
C. Water, recycled water, and sewer rates;
d. Water, recycled water, and sewer service standards;
e. Water and recycled water supply;
f. Water conservation;
9. Other water, recycled water, sewer, and storm drain related matters that may
be of concern to the City and/or utility users.

h. Representation on local and regional boards involving any of the above, as
designated by City Council from time to time.
SECTION 2. Effective Date.
This Ordinance shall take effect and be in force thirty (30) days after its passage.
SECTION 3. City Clerk's Certification.
The City Clerk shall certify to the adoption of this Ordinance and cause the
same to be posted at the duly designated posting places within the City and published
once within fifteen (15) days after passage and adoption as required by law; or, in the
alternative, the City Clerk may cause to be published a summary of this Ordinance and a
certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five
(5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after
adoption, the City Clerk shall cause to be published the aforementioned summary and shall
post a certified copy of this Ordinance, together with the vote for and against the same, in
the Office of the City Cleric.
