Ordinance Number 931ORDINANCE NO. 931 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, EXTENDING URGENCY ORDINANCE 924 RELATING TO INTERIM RULES REGULATING THE APPROVAL PROCESS FOR AND CONSTRUCTION OF BUILDING -MOUNTED SIGNS AND MONUMENT SIGNS PURSUANT TO GOVERNMENT CODE SECTION 65858 WHEREAS, the San Juan Capistrano City Council has directed staff to amend the City's sign provisions to provide more detailed regulation of signs in San Juan Capistrano Municipal Code Section 9-3.543 including but not limited to monument signs, building mounted signs, office complex signs and signs in view corridors; and, WHEREAS, the extension of the interim urgency ordinance is exempt from the California Environmental Quality Act (CEQA) Guidelines pursuantto Section 15269(c); and WHEREAS, the Planning Commission conducted duly -noticed public hearings on March 27, April 24, August 28, September 25, and October 9, 2007 to consider proposed sign code amendments; and WHEREAS, the City Council conducted duly noticed public hearings on November ' 6, 2007 and December 4, 2007 to consider proposed sign code amendments; and WHEREAS, the City Council conducted a duly noticed public hearing on December 18, 2007 to consider extension of the existing interim urgency ordinance; and WHEREAS, the City Council has carefully considered all oral and written communications at the public hearing. THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Findings. The City Council adopted urgency ordinance 924 on June 19, 2007 forthe purpose of establishing interim rules governing the approval and installation of building -mounted and monument signs pending the completion of a planning study. Additional time will be necessary tom complete the planning study and possible enactment of permanent sign regulations with respect to such signing. Accordingly, the City Council finds it necessary to extend ordinance 924 for a period of one (1) year. Section 2. Extension of Ordinance 924. Page 1 of 3 Urgency Ordinance 924 is hereby extended for a period of one (1) year pursuant to Government Code Section 65858 to expire on December 18, 2008. Section 3. Statutory Findings. The City Council finds and determines that there is a current and immediate threat to the public health, safety, and general welfare in that existing building -mounted and monument sign regulations allow excessively large sign size area, too many signs, potentially excessive lighting, and only minimal building location restrictions and that the effect from these rules has been the issuance of signage in some instances to have caused adverse visual blighting conditions within the community; further that approval of further sign programs, signs permits, or building permits relating to building —mounted and/or monument signs without additional regulatory review as provided for in this interim ordinance would result in a threat to the public health, safety, and general welfare. These findings are made pursuant to Government Code Section 65858. Section 4. Effective Date. Pursuant to Government Code Section 65858 this urgency ordinance shall take effect immediately after its passage.
