AN INTERIM URGENCY ORDINANCE OF THE CITY OF SAN
JUAN CAPISTRANO, CALIFORNIA, EXTENDING URGENCY
ORDINANCE 927 RELATING TO THE ESTABLISHMENT OF
ZONING RESTRICTIONS ON THE ESTABLISHMENT OF
MEDICAL MARIJUANA DISPENSARIES TO PURSUANT TO
GOVERNMENT 65858.
THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Findings.
The City Council adopted urgency ordinance 927 on July 17, 2007 for the
purpose of establishing zoning restrictions on the establishment of medical marijuana
dispensaries pending the completion of a zoning study.
Additional time will be necessary to complete the study and possible enactment
of permanent zoning regulations with respect to the above stated land use.
Accordingly, the City Council finds it is necessary to extend ordinance 927 for a period
of time.
' Section 2. Extension of Ordinance 927 For 10 Months and 15 Days.
Urgency Ordinance 927 is hereby extended for a period of 10 months and 15
days pursuant to Government Code section 65858.
Section 3. Statutory Findings.
The City Council finds that the approval of any land use entitlement or business
license for the uses described in Urgency Ordinance 927 would result in a threat to the
public health, safety, and welfare of the community. The subsidiary findings supporting
this statutory finding set forth in section 5 of Ordinance 927 are incorporated herein by
reference.
Section 4. Effective Date.
Pursuant to Government Code section 65858, this urgency ordinance shall take
effect immediately.
